Learned counsel for the complainants, on instructions, states at the bar that in view of the finding of the larger bench in the matter of Ambrish Kumar Shukla & Ors. vs. Ferrous Infrastructure Pvt. Ltd., CC/97/2016, decided on 07-10-2016, this matter suffers from a technical defect, therefore, the complainants may be permitted to withdraw the complaint with liberty to file fresh complaint on the same cause of action in proper form and before the appropriate forum.

          Liberty granted. Complaint is dismissed as withdrawn.
