Earlier F.A.No.621/2013 filed by the JD against the order dated 19.07.2013 passed by this Commission in C.C. No.25 of 2013, was dismissed for non-prosecution by the Hon'ble National Consumer Disputes Redressal Commission, New Delhi  vide its order dated 11.11.2013.

                        A certified copy of the order dated 10.01.2014 from the Hon’ble National Commission was received by this Commission whereby M.A. No.822 of 2013 was allowed and the order dated 11.11.2013 vide which the appeal was dismissed, in default, was accepted and the same (Appeal) was restored to its original number.

                        In this view of the matter, the Counsel  for the DH has submitted that he be permitted to withdraw the Execution Application at this stage, with liberty to file the same after the decision of the appeal or receipt of any other order, contrary to the one already passed  by the Hon'ble National Consumer Disputes Redressal Commission, New Delhi.

                        In view of the above, the Execution Application is dismissed as withdrawn at this stage, with no order as to costs, with liberty as aforesaid.

                   Certified copy of this order  be sent to each of the parties, free of charge.
