We have heard the Learned Counsel for the Petitioners and perused the impugned order, passed by the U.P. State Consumer Disputes Redressal Commission at Lucknow (for short “the State Commission”). By the impugned order, the State Commission, on an application filed by the Petitioners herein for grant of interim relief, has directed the Petitioners to deposit the entire amount, ordered by the District Forum, and permitted Respondent No.1/Complainant to withdraw the principal amount. Learned Counsel for the Petitioners has submitted that the entire amount, if so deposited, will cause hardships to the Petitioners. We are not inclined to reduce the amount to be deposited by the Petitioners. However, we do feel that as the proceedings in question are in First Appeal, pending before the State Commission, it would be appropriate and in the interests of justice that the Petitioners should approach the State Commission for modification of the interim order in order to safeguard their interest, in the event they succeed in their Appeal. If such an application is made by the Petitioners, the State Commission shall pass appropriate orders on the same in accordance with law within four weeks. With the aforesaid observations, the Revision Petition is disposed of. |
