               This complaint filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.

 

          2.       This is a complaint filed by the complainant alleging negligence on the part of the opposite parties in connection with the medical treatment provided to the complainant. The complainant filed affidavit on 03.10.2016. Subsequent to that the complainant has not turned up for facing cross examination or to mark documents to prove the case of the complainant. Since 03.10.2016 till this date the case is posted for cross examination of the complainant and on all those occasions the complainant failed to appear before this Commission. In spite of giving sufficient opportunities to the complainant to establish his case before this Commission, the complainant not availed those opportunities to prove the case put forward by the complainant. As the complainant was continuously absent, it is evident that the complainant is not interested to prosecute with this case. Hence we find that this is a fit case to be dismissed for default.

 

                In the result, the complaint is dismissed. Considering the peculiar nature of the case there will be no order as to cost.

 

             A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.

           Dictated to the Confidential Assistant, transcribed by her corrected by me and pronounced in the Open court, this the 2nd day of November 2021.
