Learned counsel for the parties heard. 

This is an admitted fact that the petitioner/opposite party-Shriram Transport Finance Company Limited did not appear before the District Forum.   The opposite party was proceeded ex parte.  They could not put up their defence. 

Learned counsel for the opposite party-complainant submits that they had sent the notice and proved the same before the District Forum.  It has not been mentioned that how much money the petitioner/opposite party fetched from selling the vehicle.  Learned counsel for the petitioner submits that he will make a clear statement before the District Forum.

Keeping in view the facts and circumstances of the case, we set aside the orders passed by the District Forum and the State Commission and give an opportunity to the petitioner/opposite party to appear before the District Forum with written statement on 1.4.2013, subject to payment of Rs.25,000/- as costs which be paid to the complainant for wasting the time.  The said amount be paid before 1.4.2013 through demand draft in the name of the complainant, Anand Thawre. 

Learned District Forum is directed to expedite the case and fix it on day-to-day hearing and decide the case during the month of April itself.
