Complainant is found absent on call but Ld. Lawyer for the complainant is present and submits that the complainant is not contacting him. No show cause petition is filed by complainant. O.P. No.2 files hazira through advocate. Today is fixed for filing show cause petition by the complainant.  

On perusal of the case record it appears that the complaint is filed U/s 12 of C. P. Act, 1986 alleging deficiency in service in returning deposited money invested in purchasing Certificate Towards Acquisition Of Product Value of O.Ps. The complainant deposited/ invested money purchasing the certificates and the deficiency pertaining to commercial transaction in the capital market and therefore is not maintainable in this Forum as ruled by Hon’ble National Commission and reported in CPR Feb’15 (II) Pg-592. Hon’ble National Commission Ruled as reported in CPR (N.C.) Jan’15 (I) Pg-22, that investment made in capital market in purchasing share of O.P. In such circumstances, there is no relationship of consumer and service provider between the parties.

In the light of the above findings of Hon’ble National Commission, the consumer complaint, being No.CC-27/2015 be and the same cannot be entertained by this Forum, hence rejected.

Fees paid is correct.
