File has been taken up today in the National Lok Adalat. Statement of Sh.Bharat Mahajan, Advocate Counsel for the OP No.3 recorded that he on behalf of the OP No.3, offer to settle the claim of the complainant involved in the present complaint of Rs. 17,499/- as full and final payment. Amount will be paid within 45 days from the date of award/order passed by the Hon'ble Commission. Further, Statement of Sh.Manvijay Singh, Adv. Counsel for the Complainant recorded that he has no objection that if the Hon'ble Commission passed the order for refund of the mobile handset Redmi Note 9 Pro Max (Aurora Blue, 6GB Ram, 128GB Storage) i.e. Rs.17,499/- as offer made by Counsel for OP No.3. He undertook to return the above said mobile i.e. Redmi Note 9 Pro Max (Aurora Blue, 6GB Ram, 128GB Storage) along with mobile asseccories after receiving the amount of Rs.17,499/-. In case, the OP No.3 fails to make the payment within 45 days, then the OP No.3 will be liable to pay the interest on the amount @ 9% per annum.
In view of the statement given by the Counsel for OP No.3 as well as Counsel for Complainant, parties have settled the matter amicably. So accordingly, the award is passed with direction to the OP No.3 to pay the settled amount of Rs.17,499/- to the complainant within 45 days, failing wch the OP No.3 will further be liable to pay interest @ 9% per annum to the complainant from the date of the award. The complainant is also directed to return the mobile handset Redmi Note 9 Pro Max (Aurora Blue, 6GB Ram, 128GB Storage) after receiving the above said amount of Rs.17,499/- to OP No.3. The Complaint is accordingly disposed of. Copy of award be supplied to the parties, free of costs as per rules. File be consigned to the record room.
