Learned counsel for both the parties state that in view of the order dated 21.4.201, passed by the Honle Supreme Court in SLP (Civil) No.13179 of 2006, the impugned order dated 4.4.1996, passed by the State Commission may be set aside and matter may be remanded back to the State Commission to deal afresh, with liberty to both the parties to take appropriate pleas available to them, in accordance with law, before the State Commission. In view of the above statement given by the learned counsel for the parties, the impugned order dated 4.4.1996, passed by the State Commission, is hereby set aside and matter is remanded back to the State Commission to deal with the matter afresh, with liberty to both the parties to take appropriate pleas available to them, in accordance with law. Since the matter is quite old one, State Commission shall make all the endeavor to decide the same, preferably within six months, from the date of receipt of record. The appeal stands disposed of accordingly. Parties shall appear before the State Commission on 6.2.2012. Dasti to both the parties.
