ORDER

By Smt Padmini Sudheesh, President On 28/12/02 the complainant had deposited Rs.75,000/- in the respondent institution as per Fixed Deposit Receipt No.170. The agreed rate of interest was 15%. Respondents 2 to 5 are the partners of the firm. But the amount was not returned till date. Hence lawyer notice was issued. But no reply and no remedy so far. Hence the complaint. 2. The respondents are set exparte. 3. To prove the case complainant has filed affidavit and two documents which are marked as Exhibits P1 and P2. 4. According to the complainant he is entitled to get back the amount shown in Exhibit P2 deposit receipt with interest. He also claims for cost and compensation. 5. There is no evidence to the contrary. 6. In the result the complaint is allowed and all the respondents are directed to return the amount shown in Exhibit P1 Fixed Deposit Receipt of Rs.75,000/- (Rupees Seventy five thousand only) with 15% interest per annum from the date of deposit till today and 6% interest till realization with cost of Rs.1000/-. Comply the order within one month. Dictated to the Confdl. Asst., transcribed by her, corrected by me and pronounced in the open Forum this the 5th day of November 2008.
