CC No.334 of 2023.

Sachin Mittal        Vs.    Allen Career Institute.

 

Present:       Sh. Ankur Kr. Panwar, Adv. for the complainant.

 

1.                 Counsel for the complainant placed on record documents Ex.C8 to Ex.C12.

2.                Brief facts of the case are, complainant’s daughter joined pre-medical coaching class with the Allen Career Institute Pvt. Ltd., having of the branch offices at Mohali and he deposited fee in the sum of Rs.1,22,000/- and the opponents issued attendance card having bar code No.1000554959 in favour of the daughter of the complainant. As per the version of the complainant, his daughter  could not continue her coaching classes with the opponent No.2 as she started facing medical problem and the opponents assured to accommodate her, by giving her online coaching, for which ultimately, they failed, neither they refunded the fee.

3.                There is no concrete proof, as to whether the complainant ever raised his grievance in written form with the opponents. Under the circumstances, in order to maintain the balance, this Commission is of the view, in case, appropriate directions are given to the opponent No.2 to considered complainant’s daughter case of refund of fee in the light of their own instruction Ex.C8, within the time given by this Commission and at this stage, no notice is required to the opponents as no adverse orders at this stage, being passed against them.

4.             Without commenting anything further, the complaint is dismissed, at this stage, it be pre-mature with the directions to the opponent No.2 to consider the case of the complainant, for refund of fee within the period of 40 days from the date of submission of claim papers by the complainant, if already not submitted and if already submitted, then within the period of 40 days, in either way by speaking orders and thereafter, if the complainant is not satisfied from the order of the opponent No.2 with regard to refund of his fee, he may file afresh complaint before the Commission and in fresh complaint, he will disclose the particulars of this complaint and its fate. Certified copy of this order be supplied to the complainant, free of costs and he at his own responsibility will deliver the same upon the opponent No.2 either by hand or through registered post, as the case may be. File be consigned to the records.
