ORDER

Learned Counsel for the Petitioners submitted that he has filed this Revision Petition against the Order of the Uttarakhand State Consumer Disputes Redressal Commission (for short ‘State Commission’) dated 08.01.2024 which dismissed his Appeal on grounds of non-prosecution.

He submitted that the absence of the Counsel for the Petitioners before the State Commission was not willful or intentional and that the matter be remanded to the State Commission so that the case may be decided on merits.

On perusing the record and after hearing the submission, the matter is remanded to the State Commission to hear the same on merits subject to a cost of Rs.7,500/-  to be deposited in the legal aid fund of the State Commission by the Petitioner/Appellant and another Rs.7,500/- to the Respondent/Complainant for his miscellaneous expenses towards litigation. 

The Order of the State Commission dated 08.01.2024 is set aside.

Parties to appear before the State Commission on 17.09.2024.

The Revision Petition is accordingly disposed of.
