         The case of the complainant is that he has purchased a Flight ticket from Cochin to Doha with a stand over at Sharjah, from the 1st opposite party by paying Rs.11,556/- through 2nd opposite party. The status of the ticket was OK. He purchased the ticket to travel on 28/05/16. Accordingly, his journey started from Cochin by Air Arabia flight with a boarding pass given by the 2nd opposite party to travel from Cochin to Doha. Whereas, the officers of Sharjah airport prevented the complainant from Sharjah to Doha stating that there is change in his name shown in the ticket and passport. Thereby the complainant could not continue his journey and he was forced to stay at Sharjah for one day. In fact there was no such change in the name. The complainant informed regarding the incident to the opposite party and demanded to refund the ticket fare. Whereas, the opposite parties were not amenable for that. Moreover, the complainant has lost his job at Doha since he could not reach there in time due to the irresponsible acts of the opposite parties. The 1st opposite party did not arrange a return ticket for the complainant from Sharjah to Cochin. They also not arranged any accommodation to the complainant at Sharjah. The luggage of complainant was also not returned in time. Being a blood pressure patient and medicines were happened to be in the luggage, the complainant suffered a lot without medications.

         2) There after the complainant arranged his return ticket by another flight from Sharjah to Cochin on 29/05/16 through his relatives at Kerala and also he was forced to pay Rs.25,756/- to getting a return journey ticket. The opposite parties returned his luggage only in the midnight of 29/05/16. By all these illegal actions of opposite parties the complainant happened to sustain unnecessary mental agony, financial loss and grave hardship which amounts to utter deficiency in service as well as unfair trade practice happened on the part of opposite parties. Hence this complaint is filed for getting relief.

         3) On receiving complaint notice was properly sent to both opposite parties. Even after accepting the notice both the opposite parties neither appeared before the Forum nor submitted any version, hence both the opposite parties set ex-parte and the case posted for complainant’s evidence.

         4) From the side of complainant proof affidavit filed in which he has affirmed and explained all the averments stated in the complaint in detail. He also produced ten documents which are marked as Ext. P1 to P10. Ext. P1 is the ticket issued by the opposite party dtd.23/05/16; Ext. P2 is the invoice issued by the 2nd opposite party for Rs.11,556/- dtd.25/05/16; Ext. P3 used boarding  pass for Cochin to Sharjah dtd.28/05/16; Ext. P4 boarding pass issued for Sharjah to Doha dtd. 28/05/16; Ext. P5 is the copy of E.ticket; Ext. P6 is the invoice issued by 2nd opposite party for Rs.25,256/- dtd.28/05/16; Ext. P7 is the used boarding pass dtd.29/05/16; Ext. P8 is the copy of receipt voucher dtd. 25/05/16; Ext. P9 is the copy of Passport of complainant and Ext. P10 is the copy of Visa. We have gone through the contents of proof affidavit and perused the documents produced. We heard the learned counsel for the complainant in detail. Since there is no contra evidence available before us we are inclined to accept the proof affidavit filed by the complainants.

         In the result, we allow this complaint and the 1st opposite party is directed to pay Rs.37,312/- (Rupees Thirty seven thousand three hundred and twelve) the total ticket charge, to the complainant along with Rs. 50,000/- (Rupees Fifty thousand) as compensation and cost, within one month from receiving copy of this order. Failing which, the complainant is entitled to get 12% interest for those entire amounts, till realization.
