This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties.  As there was delay in filing the complaint, the complainant filed IA.447/2022 to condone the delay in filing the complaint.  Hence notice was issued to the opposite parties in respect of the delay condonation petition.  The 1st opposite party appeared and filed objection to IA.  The notice issued to the 2nd opposite party returned with endorsement ‘no such addressee’.  Hence the case was adjourned to 19/11/2022 for hearing on IA and for taking steps against the 2nd opposite party.  On 19/11/2022 also the complainant was absent and no steps taken.  After 26/08/2022, the complainant was continuously absent.  On the other hand the 1st opposite party was present on all posting dates.  In view of the continuous absence of the complainant and not taking any steps against the 2nd opposite party by the complainant, we find that the complainant is not interested to further proceed with this complaint.           

In the result complaint is dismissed for default.  The complainant is directed to pay Rs.1000/- (Rupees One Thousand Only) to the 1st opposite party within 30 days from the date of receipt of this order. 

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
