Mr.Gurbachan Shah, authorized representative for the Op No.2 alongwith Mr.Rajesh Kaul, Adv., for the Ops No.1 to 4.
Today the case is fixed for settlment. Authorised representative for the Op No.2 has filed his authority letter and also placed on record a copy of letter dated 11.02.2019. Authorised representative for the Op No.2 alongwith Mr.Rajesh Kaul, Advocate by making a separate statement states that as per letter No.APS-993829-LC/RN-96/DC-2011-12/APS-7DI dated 11.02.2019 received from O/o Major-Sunil Kumar Offg Col APS (PLI) for Addl. DG APS, approx. admissible death claim amount is Rs.9,49,950/- as per calculation sheet and on receipt of required documents i.e. photocopies of first page of bank passbook, one cancelled cheque, NEFT form, LI-9 form, Aadhar card and PAN card of the complainant, the said amount will be paid within 30 days.
Counsel for the complainant also by making a separate statement states that he has read the statement given by the authorized representative of Op No.2 and agree with the same; so, he withdraws the present complaint being fully satisfied. In case, the Ops fail to fulfill its commitment as per the above statement, the complainant shall be at liberty to invoke the jurisdiction of this Forum under section 25 and 27 of the C.P. Act, 1986.
Heard. In view of the statement made by both the parties, it is clear that matter has been settled amicably; hence, the present complaint is hereby dismissed as withdrawn being fully satisfied. However, it is made clear that the Ops shall be bound by their statement made before this Forum today i.e. 26.02.2019. In case, the Ops fail to fulfill its commitment as per the above statement, the complainant shall be at liberty to invoke the jurisdiction of this Forum under section 25 and 27 of the C.P. Act, 1986.
A copy of this order be sent to the parties free of costs and file be consigned to record room after due compliance.
