SRI.P.V. JAYARAJAN, PRESIDENT:
This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This complaint is filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. This complaint was admitted on 07/08/2019 and posted to 20/09/2019 for appearance of the opposite party. Notice issued to opposite party returned twice with endorsement no such ‘addressee’. Subsequently since 25/10/2019 till 07/03/2022 this case was posted for taking steps against the opposite party by the complainant. Though sufficient opportunities were granted to the complainant since 03/12/2019 the complainant was continuously absent and not taken any steps against the opposite party. Hence the process could not be completed in this case. In the above circumstances we find that the complainant is not interested to further proceed with the complaint. Hence we find that this is a fit case to be dismissed for default.
In the result the complaint is dismissed for default. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
