As per Shri Justice Shantanu S. Kemkar :                       

            This revision petition has been filed under Section 17(1)(b) of the Consumer Protection Act, 1986 (For short ‘Act’) challenging the order dated 19.12.2013 passed by the District Consumer Disputes Redressal Forum, Bhopal (For short ‘Forum’) in C.C.No.638/2013 whereby the Forum has proceeded ex-parte against the petitioner as petitioner failed to appear before the Forum even after receipt of notice of the complaint.

2.                     For the reasons stated in the revision memo we are of a view that there was sufficient cause for absence of the petitioner before the Forum when the case was fixed and there was also sufficient cause for not filing reply to the complaint in time.

3.                     In the circumstances, we set-aside the impugned order and permit the petitioner to file reply within 30 days from today, however, subject to payment of cost of Rs.1000/- payable by the petitioner to respondent no.1/complainant within aforesaid period of 30 days.

4.                     The Forum shall thereafter proceed in the matter in accordance with law.

5.                     Parties to appear before the Forum on 03.01.2020.

6.                     With the aforesaid directions, the revision petition is disposed of.
