Perusal of the record shows that complainant was lastly appeared on 16.12.2019 wherein application for impeadment of M/s Automobiles is taken on record and OP was directed to file reply. Thereto, matter adjourned several times still neither complainant appeared nor pressed his application for impleadment of M/s Automobile as party. Since matter is still at initial stage and in fact vide order dt. 10.03.2023, in the absence of complainant, this Bench has still allowed his application and complainant was directed to file Amended Memo of Party still neither he appeared nor filed amended memo of parties. It seems that complainant is not interested in contesting the matter. Commission is not inclined to accommodate complaint any further as he has failed to press his own case. Therefore, the complaint is dismissed in default for willful non-appearance, non-prosecution in light of the detailed observation. File be consigned to record room.
