Hazira is filed on behalf of the Complainant through Advocate.
The case is fixed for argument.
No step is taken by the O.P.
After hearing argument from the complainant the Commission proceeds to dispose of the case as hereunder: -
The complainant’s case is that he is a Consumer No. being S550881 under the O.P. for cultivation purpose and used to pay electric bills regularly but he received the bill dated: 30-07-2011 for Rs. 1,95,512/- and on protest it was reduced to 1,52,487/-. The complainant received a letter dated: 02-02-2013 from the O.P. demanding a sum of Rs.1,56,469/- showing for the bill period 08/2011 with consumption units 79,487 with threat of disconnection of electric line and thereafter another letter dated:- 01-03-2013 was received from the O.P. with the direction for making payment as aforesaid within seven days in default disconnection of the electric line. But in the previous meter reading dated: 28-01-2011 the unit consumption is shown as 6,947 (19457-12510) and thus the disputed bill period 08/11 far exceeds the consumption units than the previous bills. The complainant has therefore approached this Commission for appropriate relief challenging the said bill 08/2011for Rs.1,56,469/-.

The O.P. contested the case by filing a written version denying all the material allegations made in the complaint contending inter alia that the bill in question has been prepared on the basis of actual consumption of electricity and as such the case should be dismissed.
Having regard to the facts of the case, submission and documents on record it is found that the disputed bill 08/2011 has been drawn taking into account 79487 Units consumption whereas the consumption for the previous period dated: 28-01-2011 is shown as 6947 units. It is the rule of Electricity that whenever discrepancy arises average consumption is to be taken for previous six months and applying this formulae the bill in question cannot be accepted as valid and legal.
Thus considering the entire facts and circumstances of the case and the materials on record the Commission is of the view that the O.P. should revise the disputed bill of 8/11 by reducing the amount of Rs.1,56,469/- to a round figure of Rs.40,000/-
With this observation the case is disposed of in favour of the Complainant by directing the O.P. to revise the disputed electric bill 08/2011 for Rs.40,000/- in place of Rs.1,56,469/- and the complainant after receipt of the revised electric bill will pay the same within two months thereof.
Both parties be supplied copy of this Order free of cost.
