This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. The matter was posted for hearing on admission on 27/05/2022, 08/06/2022 and today. When the case came up for consideration today the complainant was present.
Heard the complainant on admission. We have carefully gone through the complaint and the documents produced by the complainant along with the complaint. Admittedly the complainant is a tenant of the opposite party, on going through the first document produced along with the complaint i.e., the rent deed dated 01/06/2020. It is revealed that there was no provisions in the said agreement where in the opposite party agreed to render any sort of service to the consumer. Hence we find that this complaint is not maintainable before this Commission as the same will not come under the purview of Consumer Protection Act 2019. In view of the above discussion, we find that this is a fit case to be rejected as not maintainable before this Commission with a liberty to the complainant to approach the appropriate forum for redressing his grievances.
In the result complaint is rejected as not maintainable. The complainant can approached the appropriate forum for redressing his grievances.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
