1.       This complaint is filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.

2.       This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complaint notice was issued to the opposite party. As the opposite party not appeared on the date fixed for the appearance or on the subsequent dates, the opposite party was called absent and set exparte. Since 30.12.2021 this case is adjourned for the purpose of filing affidavit of the complainant. As the complainant was continuously absent, notice was issued to the complainant to appear before this Commission to further proceed with this complaint. The said notice issued to the complainant was returned with endorsement "address is insufficient". The above said notice was issued to the complainant in the address furnished by the complainant in the complaint. In view of the continuous absence of the complainant, we find that the complainant is not interested for further proceed with this complaint.

In the result, the complaint is dismissed for default. There will be no order as to costs.

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
