ORDER

 

JUSTICE SHRI.P.Q.BARKATH ALI   : PRESIDENT

 

          Heard.  It is seen from the records that appellant was set exparte by the Forum.  Taking into account the nature of the contentions raised by the parties I feel that an opportunity should be given to the appellant to contest the matter on merits.  Hence appeal will be allowed on payment of cost of Rs.5,000/-  to the complainant.

          In the result, appeal is allowed.  The impugned order allowing the complaint is set aside.  The matter is remanded to the Forum for fresh disposal in accordance with law.  Both parties shall appear before the Forum on 28/02/2017.

          The appellant is permitted to pay the cost before the Forum.
