Appellant Mr. A.F. Banaji appeared in person and filed an application today stating his displeasure and dissatisfaction on account of issuance of notice of this appeal to him. He submitted that before   five years the matter has been settled by the order passed by Addl. District Forum, holding the respondents responsible for deficient service and liable to pay compensation. In view of his submission we directed the Shirastedar to verify the decision given in this appeal earlier. Accordingly the Shirastedar obtained zerox copy of the order passed by this Commission in this appeal on 18/10/2006 and it is placed before us. Its pecusal, shows that the order dated 3/9/2002 passed by Forum below in CC No. 192/2002 is set aside as per said order and the case is  remanded back to the Forum for fresh trial according to law. Thus, it is clear that present appeal has been already disposed of on 18/10/2006. But inadvertently on the basis of second set of appeal compilation, the appeal came to be re-registered and notice has been inadvertently issued by the Registrar (Legal) to the appellant. Shirastedar to be careful in future in this regard. The proceeding of the present appeal is closed and accordingly appeal is disposed of
