ORDER

The complaint is taken up for final order.

In brief, the complaint is that Jagannath Ghosh, the resident of Karidhya, Suri, Birbhum applied for service connection of electricity before the Station Manager, WBSEDCL, Benepukurpara, Suri, Birbhum. He maintained all formalities of the official procedure and deposited quotational money on 09/11/2012. But the O.P did not effect service connection inspite of several remainders given by the complainant.

The Station Manager and Divisional Manager, WBSEDCL, Suri, Birbhum contested the case by filing written version. As per their version the complainant did not submit way leave certificate. Due to way leave problem the service connection couldn’t be effected.

On pleading of the parties the only point is to be considered  Whether the O.Ps have deficiency in service or not?

Having gone through the documents filed by the complainant it is clear to us that the complainant applied for service connection in proper way and deposited earnest money and quotation money of ₹ 200 and ₹ 800 respectively vide form No. 5000064768 and receipt No. 128400023993. The O.P No.1 also received security deposit of ₹ 1049 on 09/11/2012 from the complainant (receipt No. 130200024038). It means that the complainant applied for electric connection in proper way. The documents speak that an angle for electric line exists on the wall of the complainant’s house. This angle is used for drawing service line to other house. Definitely the O.P No.1 noticed it at the time of spot enquiry. The line has been drawn over a high-drain. There is no objection of the Panchayet for the line.  It is also revealed from the documents that O.P No. 1 issued quotation after spot enquiry. It can be presumed that the O.P was satisfied with enquiry report, then he received security deposit. Therefore O.P No.1 cannot take plea that there is no way leave.

Inspite of that it is seen from the record that the complainant submitted way leave certificate to the O.P No.1. The Panchayet Prodhan has issued no objection certificate in favour of the complainant. the complainant has filed the same to the O.P No.1. so, there is no question of way leave. The complainant should not be deprived from service connection of electricity to the house which is used to be fixed for drawing line to other house.

From the above discussion the Forum thinks that the O.Ps have deficiency in service.

So, the case stands.

Proper fees have been paid.

Hence,

O R D E R E D

that C.F case No. 72/2014 be and the same is allowed on contest against the O.Ps.

            The O.Ps are directed to effect the service connection of electricity to the complainant’s house within one month from the date of this order failing which the complainant shall be at liberty to resort to due process of law and procedure.  Considering the circumstances no other relief is allowed at this stage.

Copy of this order be supplied to the parties each free of cost.
