1. The Case of the Complainant is that the Complainant purchased a Voltas Visi Cooler 320 Ltr. Model No. 320 Sl. No. 5410652A19C004859 for Rs. 28,000/- vide bill No. 1768 dated 29.05.2019 from O.P. No.1. On 26.01.2020 complaint was made for non-function of the cooler. No one came for inspection. On 06.02.2020 again the Complainant went to O.P. No.1 but he refused to solve the problem although it was within the period of warranty. Being harassed complaint was filed.
2. The dealer, O.P. No.1 is authorised to sell the product of O.P. No.2. The product was having 12 months warranty and for domestic use. The defect carriers manufacturing defects. The Complainant was advised to approach the authorised service centre. The answering O.P. has no relation to any service or repairing or replacement of the product. The complaint is bad for non-joinder of the necessary party. The service provider has not been made party.
3. The O.P. No.2 has been set ex-parte.
4. The Complainant purchased the Visi Cooler vide receipt No. 1768 dated 29.05.2019. The dealer is only concerned with sale of the product. The service provider has not been made party nor the O.P. No.2 has been informed about the manufacturing defect at any point of time.

It is the admission of the Complainant that the product is used for commercial use to keep cold drink and confectionaries. To earn his livelihood the product has been purchased.

Taking into consideration the circumstances of the case as the complaint has not given any complaint before the O.P. No.2 nor made party to the service provider, accordingly the complaint is dismissed.
