Advocate for appellant submits that the respondent/complainant has filed a complaint before the District Commission to fix the pension in accordance with the amended Act, but, the complainant has not furnished any pension account details to verify whether he is eligible for pension or not.  Inspite of letter correspondence made with employer/R-2, they have not furnished any details with respect to the pension account.  Without details of pension account, this appellant is not able to calculate the pension payable and eligibility.  Inspite of that the District Commission allowed the complaint and directed the appellant to pay the arrears along with costs. 

We noticed here that without the pension details the appellant is not able to calculate the eligibility of the pension of the complainant.  Hence, it is proper to remand the matter to the District Commission to adjudicate the matter afresh by issuing notice to both parties and call for evidence with respect to the details pertaining to the pension account of the complainant.  Accordingly, the appeal is disposed-of.

The amount in deposit shall be refunded to the appellant.
