2.                This application has been moved for review of order dated 30.01.223 (wrongly mentioned order dated 31.01.2023 in the application). On perusal of the application, it reflects that the complainant wants to summon Brij Bhushan, Sunil Kumar and Ashwani Kumar, all the three officials of Star Health and Allied Insurance Company Limited in main complaint case No.36 of 2023 wherein order dated 30.01.2023 was passed. This Commission after hearing the complainant, issued a notice to Star Health and Allied Insurance Company Limited with whom the complainant was insured and having policy issued by the Insurance Company. Now this application has been moved for not issuing notice to above-referred three persons being officials of the company, is required to be reviewed and notice to them be also issued in the complaint.

3.                We have perused order dated 30.01.2023 which reflects that the Health Insurance Policy was issued by Star Health and Allied Insurance Company Limited and complainant is consumer of the above-referred insurance company and not of the officials of the company in their individual capacity. In these circumstances, it was held that the complainant has not cause of action to file the complaint against these respondents as he is consumer of Star Health and Allied Insurance Company Limited and notice to insurance company has already been ordered to be issued. As there is no apparent illegality on the face of order dated 30.01.2023 and this Review Petition under Section 40 of Consumer Protection Act 2019 is not maintainable. If the complainant is aggrieved with the order dated 30.01.2023, he can seek the remedy of appeal or revision as per provisions of the Act and present application for review of order dated 30.01.2023 is not maintainable and same is hereby dismissed.

4.                This order be communicated to the parties free of costs and file be consigned to the record-room after due compliance.
