    COMPLAINT FILED: 28.02.2009 BEFORE THE DISTRICT CONSUMER DISPUTES REDRESSAL FORUM AT BANGALORE (URBAN) 09th APRIL 2009 PRESENT :- SRI. A.M. BENNUR PRESIDENT SMT. M. YASHODHAMMA MEMBER SRI.A.MUNIYAPPA MEMBER COMPLAINT NO.509/2009

    O R D E R

    This is a complaint filed U/s. 12 of the Consumer Protection Act of 1986 by the complainant seeking direction to the Opposite Party (herein after called as O.P) to replace Aqua Water Purifier by name RO with Aqua Water Purifier Sense RO and pay a compensation and litigation cost on an allegations of deficiency in service. The brief averments, as could be seen from the contents of the complaint, are as under: Complainant purchased one Aqua Water Purifier from OP for a consideration of Rs.14,500/-.

    He paid an advance of Rs.2,500/- vide receipt No.981 on 28.04.2008. OP promised to deliver the said Aqua Water Purifier to his home. Within two hours one of the representative of OP brought Aqua Purifier by name RO. It was not Sense RO for which complainant placed the order. The repeated requests and demands made by the complainant to OP to deliver the Aqua Purifier as per the order placed by him went in futile. Thus he felt deficiency in service on the part of the OP. For no fault of his, he is made to suffer both mental agony and financial loss. Under the circumstances he is advised to file this complaint and sought for the reliefs accordingly.

    2. On admission and registration of the complaint, notices were sent to the OP. Though OP is duly served with the notice remained absent without any sufficient reason or cause. The absence of the OP does not appear to be as bona fide and reasonable. Hence OP is placed Ex-parte.

    3. In order to substantiate the complaint averments, the complainant filed the affidavit evidence and produced some documents. OP didn’t participate in the proceedings. Then the arguments were heard.

    4. It is the case of the complainant that he being carried away with the advertisement and publication issued by the OP thought of purchasing one Aqua Water Purifier Sense RO. The cost of which was Rs.14,500/-. He paid an advance of Rs.2,500/- on 28.04.2008. OP passed the receipt No.981. It is produced. OP promised to deliver the said Aqua Purifier to his home within two hours. Thereafter one of the representative of the OP came to his house and delivered one Aqua Water purifier RO. It is not acceptable to the complainant because he felt it is not of a good quality.

    5. Complainant placed the order for Aqua Water Purifier Sense RO. That was not delivered. The repeated requests and demands made by the complainant to replace it went in futile. The Aqua Water Purifier supplied by the OP was not working properly nor giving expected purified water. Hence complainant suffered both monetary loss and mental agony. The repeated requests and demands made to OP went in futile. The evidence of the complainant which finds full corroboration with the contents of the undisputed documents appears to be very much natural, cogent and consistent. There is nothing to discard his sworn testimony.

    6. It is a quality of evidence that is more important than that of the quantity. The non appearance of the OP even after due service of the notice leads us to draw an inference that OP admits the allegations made by the complainant. Though complainant invested his hard earned money he is unable to reap the fruits of his investment. We are satisfied that complainant is able to prove the deficiency in service and unfair trade practice on the part of the OP. Hence he is entitled for the relief. Accordingly we proceed to pass the following:

    O R D E R

    The complaint is allowed in part. OP is directed to replace brand new defect free Aqua Water Purifier RO by Aqua Water Purifier Sense RO for the same cost and take back the water purifier supplied to the complainant and pay a litigation cost of Rs.500/-. This order is to be complied within four weeks from the date of its communication. Failing in which OP is directed to refund Rs.2,500/- paid as a part payment of the purifier along with a compensation of Rs.5,000/- and litigation cost of Rs.1,000/-.

    Dear sir ,
    1. we purchased a Aquaguard total-Gold Nova on dated 11/5/2009.
    2. Cheque issued for Rs 9590/- addressed to Eureka forbes.cheque number -594038 (
    bank of Baroda )
    3. One of your personal Named Mr. M.S Shaikh had come with a mechanic and installed it.
    4. The name of the Mechanic was Prakash and the Mobile no 9323410255.
    5. We were told that they will send the receipt after the cheque is realised.
    6. till date we have not received the receipt.
    7 .several times we contacted Mr. Shaikh ,But he has not sent the receipt

    8. we complained at your office ,in the land line 39883333 to Shradha.- the
    complain number -55391507,and the personal code number -81894459,and the permanent
    code number-1006147225
    9. till date we have not received the original bill.Requested to look in the matter
    at the earliest and send us the bill,
    10. I never expected this kind of treatment from a well known organisation

    Unhappy improper installation of aquaguard integra hi life water purifier

    i, mrs. vanamala umesh, accounts officer in defence accounts department in bangalore under ministry of defence, bought aquaguard integra hi life from the agents of eureka forbes ltd. on 14/09/2009 in my husband's name shri. umesh arikady. the product was not properly installed. the technician has kept the product on the kitchen slab promising to return on the next day with the stand offered freely alongwith the product to mount it on the wall. till now no one has turned up. many number of complaints to all concerned have not helped. we are not able to use the product inspite of making full payment of Rs. 19,900/- on 14/09/2009 (one and half months back) till today. don't know what to do and whom to approach. just got disgusted with the company and the product.

    Default Very Worst Service in Eureka Forbes - Water Purifyer.

    Dear Sirs,

    I am using Eureka Forbes water purifyer for more than 6 years. Every year i am renewed my contract. Still my contract is valid up to 22.02.2010. One week before i registered one complaint and they have given me one Request No. 0056186824 on 25.11.2009. Two days before also i spoke to 39883333 to send a service person to attend my fault. Still they didn't send a person to attend my problem. What to do further. Please advice me is it possble to take any legal action against Eureka Forbes.

    I am awaiting for your reply soon.

    Dear Sir,

    I have purchase Eureka Forbes water purifier at 21 march 2010 form J. K. Electricals B 1/11 sector 18 Noida. In mannual book of Eureka Forbes water purifier is mentioned, it has capacity of filter the water near about 1800 L. but is unable to filter even 100 l of water. I made complain to customer care but they convey me the product is not successful in Delhi NCR.

    So I request you, to kindly look into the matter and send me replacement water purifier as soon as possible

    Exclamation Eureka forbes no proper response

    Hi readers,

    I purchased water purifier on 04-05-2010 named reviva costing 9990. I paid the full amount using card on the date of purchase, on the same technical person came for installation, during installation pipe installed specially for joining the tubes of the machine got damage, we found water leakage. the technical person confirmed by saying tomorrow 05-05-2010 i will definitely come and change this, till date i havent received any call from them. when i contacted the sales person who contacted me for this product he had no proper response, nearly 8 times i called him.

    Smile Aquagaurd pump model water filter

    My complaint No registered with Eurekha forbes at 39883333 on 19/7/2010 is 58792083.The water filter is on AMC up to June 2011.The motor is functioning intermittently and your engineers certified that the motor is to be replced.Since 19th I have been calling your office and they care two hoots,though they promised to come.Time and again I have been complaining and bringing it your notice the irresponsible attitude of your customer care and nothing tangible happened sofar.The only option you are giving me is to go to the consumer court for claiming the compenstaion for all the harrasment from your people.Kindly dont drive me to take such action when your name is already tarnished in the market and try to bring a better customer relation.

    Default Compnay is not providing free servicing though committed for the same

    I purchased Aquaguard reviva model from Eureka Forbes authorised agent "Mr. Rishin Dhara (Emp Id: 9026641), on 12th August, 2010. My customer Id is 1006365572. During purchasing, he informed me the machine is having eight free servicing at the intervel of every 3 months. After completion of one year, now the company is refusing to provide free servicing though four unused service coupons are lying with me. Please guide me. My contact no. is +918981909293

    I purchased Acqaguard Total Protect Water Purifier on 31st July 10. since its installation it has been giving one problem or the other . Compliant was made and attended bt it resurfaced after few days. Tele complaint was launched at dwarka office on tel no. 30780848 etc but the words fell on deaf ears. I requested the person on phone to put me through to senior manager or any responsible executive but the person took my address and dropped the call. Sir i have spent my hard earned Rs 13500.00 to get clean water but i am not satisfied with the product. Small ants manage to enter the pure water purifier which we have to filter again. I request tou to either replace the piece or take it away and refund my money. In case my request is not heeded I have no option but to go to consumer court. The sole aim of your sale person was to sell the product which he did smartly and efficiently but in turn we have been BE-FOOLED.

    Default lack of response for complaint of malfunctioning of AQUAGUARD TOTAL ROBOT.

    Our water purifier did not work since the main board lost its function. machine is still under the cover of warranty.we gave our complaints to the nearest service center and the employees did not give any proper reply. we also called 39883333 still no response. WE are frustated .i want proper service. for the past 25 days iam suffering. i have no other go but seek legal help.

    Default Aqua gaurd - shameful service

    Total Protec+, bought in Dec 2010, developed problems. But the real harrasment is the total lack of intent to help either from HELPLINE, SERVICE CENTER or even service head. Called helpline on 27th may 2011, they assured help within 48 hrs., no help till the service center is called directly, and even then only assurances. Subsequently called service head on 31 may, resulted in technician's visit. Now it is lack of spare parts sited to be the delay in repair. Service center assured rectification within 2 days, ie by 1st May, which is another lie. One wonders how Eureka Forbes does business, they should be ashamed of the false promises and claims. Wakeup Eureka, you may be getting away but the cost of your reputation.

    Angry Purchased Acquaguard Reviva on 21st May 2011 and installation is not done till date

    hi Sir,

    I purchased one Acquaguard Reviva RO from Eureka Forbes on 21st May 2011. I paid the amount 9990 on the same date and received the water filter next day. But the technician who delivered the unit said that wall mounting stands are not available and will provided soon. Till date (15 days after purchase) I have not received the stand and the installation is pending. I called to the sales guy with whom I made the deal. He said he has excalated to management about this and no reply from them. Now a days he is not picking my phone also.
    I am feeling like a dead investment as I am not at all able to use the filter.

    Please guide me for fighting against Eureka Forbes.

    We have purchased the 10 Litre Euroka forbes Model rivava water purifier in the month of Sept 2010, Now the product is almost 10 months old. From the day one, we have issue in the water purifier. Now the water purifier takes 6 to 8 hours to fill the 10 litres. When we reported the same to the customer service, an engineer is allotted and he confirmed that the Water filter had gone bad and need to be replaced. When asked, it would cost Rs. 3,000 for the replacement. When asked for the warranty, he claims that filter is not covered under warranty. Since the product is of no use because of the filter failure. we need the replacement done for free of cost. Again, we tried to call the representative, and he says that this product will not suit corporation water, it is only useful for bore water. This answer is not conveniable and need replacement.
