I had contracted DRS Agarwal Packers to ship my household goods from NCR/Gurgaon to Sada, Vasco Da Gamma/Goa in November, 2011. My contact person was Mr DS Pandey, HHG Desk Officer (from Narsingpur, Distt Gurgaon location of DRS Agarwal Packers).

On the demand of DRS Agarwal Packers, I had pre-paid 100% of entire transportation and insurance amount (totalling 76,000.00) prior to the shipment of goods online on Nov 7th, 2011, all in good faith. For the record, the Transaction No: 2000000053 and Reference No: 6314 for the online payment.

The consignment number was 578829 and the goods arrived at my residence on the evening of Nov 18, 2011.

Upon arrival of the goods at my residence in Goa, I was shocked to find that a few items had been badly damaged and some completely destroyed in transit.

I brought the damages to the attention of DRS Agarwal staff in person, documented all the damages in detail and had a DRS Agarwal representative Mr Sunil Kumar sign on the list of damaged items. Additionally, we also reported this damage to the DRS Agarwal Goa Branch Manager, Mr Suresh Vashisth on the phone. Mr Vashishth at our request came to visit our residence (Sada, Vasco Da Gamma, Goa) on Sat, Nov 19, 2011 to inspect the damaged goods and agreed to refund the amount by early following week, with an Expected Time of Resolution by Tues, 22nd Nov, 2011.

Mr Vashisht explained to us that they shall reimburse us for the value of repairs of items that could be repaired upto a total of 90% of the value of the goods.

More specifically, the agreed amount was Rs 10,750/- breakup of which is as below
1- Item No. 45 - Chest of Drawers - original worth reported for insurance/packing list Rs 10,000 - this was in totally destroyed condition before it arrived, and could not be salvaged, as has been witnessed and agreed upon by DRS Agarwal Packers representative and Branch Manager Mr Suresh Vashishth. I was told as per policy, I shall be reimburse only 90% of this amount for a total of Rs 9000/-
2- Item No. 14 - TV Table - documented worth Rs 1,000 (original worth 15,000), whose top has been cracked and has to be replaced. Estimate for repairs was Rs 3000 however we understand that as per policy DRS Agarwal could only offer us 90% of documented value for repairs totaling Rs 900/-
3- Item No. 3 - Refrigerator Balancing Knob : This arrived in damaged condition. As per Mr Vashishth's request, this was repaired by Whirlpool Dealership at a cost of Rs 850. We have the original receipt for repairs.

Unfortunately the resolution never came, and I have not received a single rupee till date.

I have been calling Mr Suresh Vashishth regularly at least 1-2 times a week without fail on his cellphone from Nov 22nd, 2011 to check on the status of the payment for damages that he had promised to us in person. I am certain I must have called him 10-12 times in a 45 day period. Unfortunatley I am getting to hear all kinds of excuses - that documents have been shipped to Delhi and are taking long in transit, that the legal department in Delhi is taking long to resolve the matter , or please give me another 3-4 days.

I also sent DRS Agarwal Packers and Movers a detailed email on 10th Jan, 2012 documenting this entire matter and state of progress in great detail asking for a resolution.

Fact of the matter remains that its been 60+ calendar days since the damaged goods arrived. I've not received a dime in payment as yet, nor do I have a confirmation when the payment shall be made.

I have exhausted all reasonable, possible means to try and resolve the matter and the only recourse that remains now is the law.

I am committed to recovering my hard earned money and more importantly to pursue DRS Agarwal Packers and Movers for their dishonest business practices, so no other customer is cheated again.

I am willing to take all legal resoucse necessary to bring DRS Agarwal Packers and Movers to justice.

Please advise on appropriate legal action, to speed up the payment of damages.
