    I was appointed as Relationship Manager in india infoline ltd at Balasore Branch with effect from 03 October 2007 by the authority of the India Infoline Ltd, with a gross salary of Rs. 8,000.00 per month and said appointment was also subject to confirmation on satisfactory completion of the probation period. India Infoline ltd. is a registered company having its principal office at Mumbai and the company represented by its branch office which is situated at Balasore,orissa. India Infoline Ltd.(a broking company) is carrying the business of various financial products through out India i.e. equity share, mutual funds, insurance etc. under various Government regulatory authorities like SEBI, AMFI, IRDA etc.
    After completion of satisfactory and successful probation period of service my employment in India Infoline ltd was confirmed as per letter of confirmation dated April 1st 2008 with subject to certain term and conditions. out of several terms and condition of the confirmation letter one of the term was that The employment can not be terminated by either side with one month notice. while i was continuing my service in India Infoline ltd at Balasore Branch as Relationship Manager, the Branch manager all on a sudden asked me to sign in a self resignation letter on 06/03/2009 which was a printed format termed as “Exit Interview” and handed over that format to me for my signature there in, but i did not agree to sign in the said self resignation format. Consequently I wanted to know from the Branch Manager about the reason for compelling me to resign from my service. But he could not assign any satisfactory reason. Thereafter on 18.03.09 the branch manager illegally handed over a letter of termination in his seal and signature in a plain paper(i.e without giving letter paid of company) . and the content of termination letter is as follows.
    “This is to information Mr.chinmay Kumar Nayak Emp Code-C44624 ,that you are terminated from your position in this company due to under performance.The company is not able to keep at your current position due to present market scenario.it is with effect from 6th march 2009.”
    In fact Branch Manager had no jurisdiction to terminate me from my services as he was not the appointing authority of mine. I was appointed by the vice President H.R. Department of India Infoline Ltd. but branch manager illegally terminated me from my service without having any authority. That apart no one month notice was served me by the authority of india infoline ltd. and without giving me an opportunity of being heard and consequently I have been also denied to defend myself.
    India Infoline ltd. usually disburses monthly salary of the employees on 3rd day of each calendar month. But the company did not pay the salary to me for the month of February 2009. Just after three days inform me about termination which shows a pre planed conspiracy against me.
    That, apart, the authority of India Infoline ltd . has deducted an amount Rs.1572/- from the monthly salary for January 2009 towards the provident fund contribution by the employee. But the P.F Account number remained blank in the pay slip. Hence it is evident from the pay slip that amount was not deposited in the provdent fund account though it was deducted from my salary. I have no record of under performance during my service tenure In India Infoline Ltd.
