O R D E R


1. This is a Petition filed by the Petitioner/Opposite party under Section 26 of C.P. Act 1986 for dismissal of complaint.


2. According to the petitioner, the dispute raised by the complainant does not fall within the Ambit of C.P. Act.


3. The point for consideration is:-
Whether the complaint should be dismissed?


4. Point :- As seen from the complaint, the complainant sought for a direction against opposite party to return the original certificates retained by her and also for compensation. She did not question the service conditions. She just asked for return of the documents on the ground that she wanted to leave the job so as to seek job elsewhere. Whether she is entitled for return of the documents or not, can be decided only after final enquiry. Whether the job undertaken by the complainant under the opposite party is a contract of service or not will be decided on completion of the enquiry only. So, without the relevant material before this Forum, we cannot, at this premature stage dismiss the complaint.


5. In the result, the petition is dismissed. No costs.
