I have Joined in a software Company in august 2010, a small company of 10 employees at hyderabad and is being lead By a CEO who is located at Alaska and a M D will be taking care of hyderabad team. from august 2010 i have provided my services to the company, Due to improper behaviour of CEO like even if i have done the work assigned to me he again says u have done nothing and u r work is not useful but he uses my services for live working and some times uses bad words like ' that fucking shit is not useful and etc' so i have decided to resign my job and handed over my resignation letter and the below are the condition for which i have signed an agreement with the company
"You will be on probation for six months from the date of your joining xxxxx PVT. LTD. and shall continue to be so until and unless specifically confirmed in writing. The probation period may be extended at the sole discretion of the management.
You are required to serve in the organization for minimum 3 years from the date of joining You will commit three years of service from the date of confirmation with xxxxxxx failing which seek legal restitution to recover cost of training, facilities and other incentives provided to you during your tenure.
During the probation period employee have to give minimum 30 days notice period in writing for release of services. However after confirmation both the parties need to give 60 days notice period in writing or 60 days salary in lieu thereof. "
1 one is after my probation period they have not provided me any letter of confirmation but still made me to continue my services.
2.Based on the second sentence they are blackmailing me to pay all the costs they have spent on me for 14 months and than leave the office or come and sit in office for rest of period in office even without doing any work and even specified even if your career spoils we dont care u need to be in office for three years.
According to me since they havent given any letter of confirmation after probation according to document i am still in probation period and i have given notice but management is not accepting, CEO is not answering my calls when i call him and not even replying to my emails and Hyderabad MD of company is also not responding to me and my education documents are also with company.
Can you please suggest me about how to proceed it would be a great help.
