Dear Sirs,

I am in a dillema now. We had developed a software with a bangalore based company. This software was a custom made software developed for our company according to our needs exclusively. For the last 5 years we have made various changes to this software to suit our business and for each of this, we paid additionally to the softcare company. Now they are demanding a fixed monthly fee which is exorbitant. We already renewed our contract for this year with them , but nothing was mentioned during that time about this monthly fee. We have also paid till feb 2010 for hosting services. Now they refuse to cooperate with us unless we are ready to pay them this retainer fee.

We had no choice, but to look out for other companies and we found one which is very much cheaper. Now the issue is that the first company refuses to give the source codes which is required to make additional changes/modifications in our software.

Please help us on this. Dont we have the rights to the source codes as this software was developed exclusively for us and it is our property?
