Respected sir/madam

on 28th of september 2009 i hve gone for dinner with my friends in METRO MAHARANI Restaurant in metro walk, rohini, sector 10, new delhi. My bill totally amounted to rs 984 inclusive of service charges which is rs.117 @10% and VAT rs.102 @12.5%. But when i asked about service charges then they have told that this is charges for waiters providing services. But it is the portion of their profit which they must have included in food prices. So they must have not charged such amount with us. It must be optional payment. But when i argue with them,they told me to go to court and file a case if u want we will not cancel it.
