Dear Mr Samanta,I had received a credit card back in august 2010 from hdfc bank. Until the february 2011, I DID not have any issues and all outstanding amount was regularly paid by me every month. I had also opted for a cash on call (loan on credit card) which was broken into emi and was added to the credit card bill every month which I continued to pay until february 2011. Post this date, I have run into some serious financial trouble due to family issues and have not been able to pay in time. There was an outstanding due of 2 months for february and march 2011. I started receiving calls from hdfc collection agents asking for the money. After a few days they started harassing me everyday and started calling me 10-12 times a day. In the last week of march 2011, I was unable to receive their calls due to work pressure and busy schedule. The bank people then sent their executive to one of my friends house (this address was not registered with the bank anywhere which the customer care has confirmed) and started asking money from them. They have traced this address unlawfully. When I asked the collection agents, they continuously shouted and misbehaved and said they are not liable to disclose any information as to where they got this address from. Sometimes they said I have given them the address and sometimes they said I have updated it in my account(at the same time, when I called credit card customer care, they confirmed no such address exists in my account). After repeated harassment, I paid a minimum amount due of rs 24000 in april. At that time , they promised some action will be taken but nothing has happened yet. Now again the same thing has started where they say, you pay the minimum amount due and we will take action. I have completely lost peace of mind and have been continously harrassed by the collection agency. I have already lodged a complaint with the bank and now one single collection agent calls me up and pressures for money. I have nearly 2 lacs outstanding in total with the bank in loans and card outstanding but I am not willing to pay anything after this treatment from bank. Please suggest how I should go ahead with this and what I should do. I am still getting messages and calls from collection agent everyday asking to pay up. Everytime they say you pay and we will take action but nothing happens. I had even asked for a letter from bank confirming that bank has taken unlawful action but they are not willing to give. From my research of rbi rules, I am sure that bank has taken illegal action but I need assistance and suggestions as to what I should do. Please help me.
