Dear Mr. Nakul,
From your post, it seems that either you are working for Gaursons or you are over satisfied customer of gaursons. If Gaursons is so good builder will you please clarify the following issues or shall we get any information
1. After getting harassed by the builder, we registered our society under the society act and formed a proper RWA but builder is saying that they will form the RWA in coming future and elect the office bearers. (As per supreme court order builder must complete this activity within six months from the first possession, where as it’s already one and half year is over after first possession) why they are willing to do so, I think meaning of RWA is Resident welfare association and not Builder Welfare association, it's nothing but a blood sucking process so that they must not leave the maintainance on which they are enjoying.
2. They are not ready to give the expense statements of the money collected by them on the name of maintenance charges from us.
3. As per our contract terms, maintenance charges should be Rs. 1/Sq. ft., but we are paying approx Rs. 1. 35 / Sq ft. to builder and for replacing anything in our homes they use to charged us at actual (Moreover they never provide the bill for the charged item).
4. They use to charge 10.3% service tax on the Maintenance but we never got any bill bearing their service tax number or the bifurcation of maintenance charges (Like electricity consumption + Maintenance charges + Service Tax etc).
5. They never use to show the approved MAP of the society, so that they may do all the illegal constructions in the society. Like they are constructing the flats in stilt floor whereas the same is passed as parking space by GDA (we took out the Xerox of maps from GDA Office under RTI – act). After number of complaints to GDA and concerned authority, but after 4 months of complaint nothing has been done by the authorities also, in RTI they replied “JAANCH JAARI HAI, KARYAWAI KI JAYEGI”.
6. Nearly 500 families are living in the society but fire fighting system is still not installed properly in the society.
7. They charged Rs. 1,00,000.00 for covered parking but still their parking is not ready after one and half year of first possession (don’t know where they are spending our hard earned money), moreover if we fail to pay them any time they used to charge very hefty amount from us, but not ready to reply on parking issue, moreover when we paid for the said space why it is not mentioned in registry and that is why they are having their own advocate who use to write all the terms in favour of builder. If any one is willing to have registry of his flat, he will face all the heat (This is the strategy of Gaursons).
8. As per the National Building Code (NBC) one car parking area must not less than 13.75 Sq. Mtr and one two wheeler parking area must not be less than 1.25 Sq. Mtr, even the same is passed in approved map of the society, but when we enquire with builder they told us that they are providing 91 Sq. ft area for 1 Car + 1 Two Wheeler.
9. They are use to force us to buy the services provided by them (like Tata Sky, Tikona Broadband), they played all sort of games to stop BSNL to enter into the premises (any one can understand what profit they are getting by forcing us to buy the services provided by them). What we know that no one can force us buy any services.
10. Till now the completion certificate and NOC is not obtained by GDA and Fire Safety Officer (FSO) and as per NBC till the completion certificate and NOC from FSO is not obtained building is not fit for possession, but we are forced to live there as it’s a home bought by us from our hard earned mney.
Keeping above issues in mind still you are saying that they are best. O yes one more thing, they charged us for A class construction and the best part is tiles are coming out from the floor and number of tiles are hollow. May be this is our mistake.... AS GAURSONS IS THE BEST "QUALITY" BUILDER... ISN'T IT...
Now think and wake up for your rights and before buying anything from them, take every thing in writting so that you may not feel cheated later, be assured that they will not give any thing in writting.
