    Default wrong commitment and delay in possession

    Sir,

    i have following issues with builder and seeking guidance to resolve it.


    Point No- 1

    1. I had booked one unit on 12th dec’06 vide receipt no. 10180714049 and serial no. 98400165221 with unit no. C1/301. Unit no. C1/301 is clearly mentioned in application form and same was also confirmed in the payment receipt issued to me, since there was neither PLC under existence nor any communication so I purposely chosen park facing unit to get the advantage of early bookings.

    BuilderCall:
    After one year, I got allotment letter in which unit no. changed to C18/504 which is non park facing unit without any pre intimation or communication.

    My Call
    I once again taken this issue with the builder through written application, if C1/301 unit allotment is not possible then pls allot me another park facing unit in C15 block.

    builder call:
    It is not possible if you want park facing unit then you have to pay additional 20% as PLC charge.

    My Call
    I was told from my regional office team then you don’t agree on this then your allotted unit will be cancelled and process for cancellation after deduction of15% unit price, which was huge money for me so was not having option other then agreeing on non park facing unit with unit no C16/601.

    “I must get park facing unit” as no PLC under existence at the time of booking”.


    Point No.-2

    2. I was clearly to told by sales executive who booked my unit that car parking space for one four wheeler vehicle is included with the unit price but after 2 years of booking date, I was in receipt of a letter to purchase parking space which was really shocking news for us, I was not prepared for this and I can’t afford it.

    “In this case car parking must be inclusive in unit price as no communication was made for purchasing car parking additionally”.


    Point No.-3

    3. I had booked unit under construction linked plan, even one more application submitted in your esteemed office at the time making 10% unit price payment before issuance of allotment letter for
    getting payment schedule as per construction linked plan along with allotment letter but request was not considered and issued allotment letter under payment linked plan.
    4. Despite of my booking date of 12th dec’2006, possession date in allotment letter mentioned in Aug’2010 where as the time booking, possession commitment made to me for 2009 mid.
    5. I was also agreed and signed to pay Rs.295/- per sq feet as maintenance charge which was not applicable to the customers who booked unit in early months of 2006 as policy matter so not an issue)
    6. Since I was not in a position to make payment as per payment linked plan so I requested to the management to issue me revised payment plan as per my earlier request, this time builder considered my request, issued revised allotment letter on dated 6th May’08 mentioning possession date is 38 month from allotment letter.
    7. In tri-parted agreement also, it is clearly mentioned that complete unit payment need to be paid before 15th Aug’10, hence possession date must be considered as 15th Aug’10.

    “As per agreement possession of the unit was due in aug’10, if possession gets delayed then interest will be paid by Sahara City homes to the financial institute for the period of delayed of possession”


    i have sent a letter to builder on above mentioned points with 15days notice period but not getting any reply on this.

    looking forwrd your views to take it up this case further with builder before filing up case in consumer form or is their any other way out to resolve it.
