My daughter served with a private company for September, October and 1 to 10th of November 2009 and tendered resignation on 10th of November 2009 in writing. She was earlier paid for the month of September and October,2009 @ Rs.13000/- per month but the salary for the remaining 10 days of November 2009 has not been paid as yet despite verbal communication at Reception counter, Accounts Department and written representations sent through speed post and email, although during verbal discussions with the receptionist as well as with the accounts department she was assured that the payment would be mad e for which the cheque is already prepared and lying with the competent authority for his signatures and as soon as the same is signed, a communication would be sent to my daughter but neither the payment has been made so far nor any communication received so far as to if the payment would be made or otherwise.
Under these circumstances, kindly advice as to if I being the father of the ex-employee can lodge a complaint with the consumer court and if so whether any notice prior to lodging the complaint would be required to be served upon the company and if so whether the same should be simple or a legal one and if legal, whether a notice in my own hand on a ten rupees non-judicial stamp paper would suffice. Kindly advice.
