Sir,

My Father (Mr.Jagdish Singh) purchased a shop in DCM Technoplaza nearly 15-20 years ago

Thats before I was even born (my current age is 19). Anyways, The payment was made in US DOLLARS (As my father was a NRI and there was special reservation for NRIs to purchase shops (or something of the sorts))

The company hired for the work either closed down or had some other problems, but until 2003 or 2004 the work on the site had not commenced!

Now the property is being established by Purearth (mall website is centralsquare(DOT)in )

We had made 50% of the payment originally - all in dollars (Around 20 Lakhs)

Recently around 3-4 years back we received documentations form the company stating that some additional expenses had to be covered - including Air conditioning and A special link to a flyover built near the mall

The payment was once again demanded in US DOLLARS (~3 lakhs)

The US Dollar rates are high as of now and getting the amount in that currency is not at all feasible for my family especially now that my dad is nearing his retirement age

Also since the company had taken the original amount and failed to deliver possession within 2-5 years of the project (as was then mentioned) , they must have obviously deposited the money. Interest on such an amount over a period of 15 years even at a rate as low as 1 % , that also amounted annually and not monthly or tri-monthly (as many banks offer) equals to nearly 3 lakh rupees! - the very amount the builders are requesting

You will notice that I have entered the minimum of minimum conditions for evaluating interest and the amount -- the actual amount will be far in excess of 3 lakhs!

How will our case rest if we were to goto a consumer court, and what tips or suggestions can you give us!?

Also - My father did try to talk to the company personnel but they seem adamant on their demands!

Thanking you
Pranav Jagdish
