1. A courier has been sent to me through MARUTI AIR CARGO COURIER from Coochbehar to Dehradun which contained some garments. Consignment/Reciept no-330552572 dated 25 Aug 09 through Franchiesse called PANDIT at Coochbehar. Now at Dehradun , one Mr Bindra gives me a ring to inform that he has got this consignment released from sales tax with some additional payment of 51000 Rs and so i have to pay an amount ranging between 500-1500 to get that released. Meanwhile he has checked up the value of items within from the sender Mr Tarun Sinha at coochbehar. Now he says that all has happened because the sender has not declared the amount of materials inside!!!
2. I have few questions for you and would like to seek assistance as how to proceed legally against these people. Please let me know-
(a) When a person books a parcel through your courier, is the responsibility of declaring the content rests with him or the company should get it out from him?
(b) Is declaring the contents an optional thing or is it mandatory?If mandatory ..Then logically all the responsibility should rest with the company to get all information before he book .
(c) When the company has booked a parcel after weighing the content and charging the required sum,won't he should own up the responsibility of delivering the content to the doorsteps of the addressee. In no case an extra amount should be paid by the sender or the Recipient for any reasons whatsoever.
(d) The company must be having the insurance against all such losses and damages and payments in the way which in any case should not be passed on the customer in any way.
