    Default Late delivery of Consignment and loss of part consignment

    On Saturday 8th August, 2009, i had hired AGARWAL PACKERS & MOVERS (transport Company), DEHRADUN (Branch Head : Mr. Khushi Ram Chaudhary, 09219860986; Ph no. 0135-2762537) to PACK & Deliver (DOOR TO DOOR DELIVERY) my 2 year old CBZ Xtreme, (Black Colour) Motor-Bike along with Black Full Face NINJA-STUDD HELMET from My Address : 837/3, sirmour marg, kaulagarh road, dehradun-248001 to my mumbai address, 1204-A, RNA HEIGHTS, 12th Floor, JV Link Road, Next to Greenfields, Andheri (E), Mumbai-400093. according to the verbal agreement of terms, the bike was to be delivered at door latest by saturday 15th August. The bike was packed and loaded for transporting in front of me. The full consignment was in two packs i.e. first packet contained my bike fully packed while the second packet had the helmet and the side view mirrors, again packed. The transport company charged me Rs. 5500 and said that all the charges and taxes are included and even the OCTROI payable in Mumbai. But at the time of billing, the billing person had superscribed on the bill that "OCTROI TO BE PAID BY THE PARTY", which was to be pre-included in Rs. 5500 according to the verbal agreement.

    Sir, Since 15th August 2009, i had been trying to track my consignment and on frequent enquiry call to the Transport company, the only answer i got was that the consignment had been dispatched from dehradun and it is lying in Delhi. Then by sunday, 16th August 2009, i got to know that the consignment is late and will only be delivered , positively by 22nd August 2009 at Point of delivery, in Mumbai. Still the Consignment did not get delivered neither on 22nd nor on 23rd August but on 24th August 2009, the person from the company came to deliver the consignment.
    While Delivery, the following problems occured:
    1. The consignment was unpacked, which was packed in front of me and was to be unpacked in front of me, (i have attached photographs as proof of unpacked consignment).
    2. out of two packs, one bike and other containing Helmet and side mirrors, the helmet was missing (the delivery person said that they didnot get the helmet alongwith), while the side mirrors were already installed on the bike.(as per the terms the second pack was to be unpacked in front of me).{the receipt says that helmet included).
    3. The delivery man was asking another Rs. 2359 on behalf of OCTROI Charges, which were prepaid alongwith the packaging charges in Dehradun.
    4. The bike front light was damaged and there are two many scratches on the body (I have proof).
    5. While unloading, the bike fell twice in front of me from the hands of the person's unloading the bike, thereby causing damage and scratches.
    5. Above all the Bike was delivered 10 days late ie was delivered on 24th August but was to be delivered latest by 15th August.

    Finally, i rejected the consignment (did not take the delivery) as it was incomplete & not in the same condition as was taken for delivery.

    Sir please help me in getting my consignment.

    Dear Sir,

    Please send a written complaint to the Aggarwal PACKERS & MOVERS. Mention all your complaint in that letter and also about the response, you want from them. Send it through registered post and keep a copy of that letter with you. Pls. provide us your complete postal address also with your next reply.

    Default Further Non Delivery of remaining Consignment

    Sir,

    As for as the written complaint is concerned, i apologize to have not sent it by now but i will definately be sending it within this week. But i would like tio through some more light.

    Agarwal Packers and Movers Requested me to negotiate so as to solve this problem. they said that sir we will get your bike repaired and deliver it to you in the next two days with full cover of all the damages, but as fo the Helmet and the BIKE COVER(the other package of the consignment) is concerned, we will get your helmet Delivered with the next four days i.e. latest by Saturday 29th August, 2009. I agreeed to it because they were ready to bear the damages. Now the day of delivery came and they delivered the bike but to my surprise, none of the scratches of the bike were removed and neither the damages to the light were repaired. now i accepted the consignment but with the verbal promise of the Delivery Man, Mr. Premarao that he will get it fixed. as for the Helmet was considered he confirmed that it will be there by saturday.

    Sir, till today 4th September, 2009 5.45 PM no helmet and bike cover has been delivered to me and if i try to contact them they disconnect the call. even my father tried to call them but they started misbehaving and abusing and their EXECUTIVE -Mr. ANUP (MUMBAI BASED) said "DO WHATEVER CONSUMER FORUM / CONSUMER COURT YOU WANT TO APPROACH, WE ARE NOT AFRAID OF THESE PEOPLE AS THIS IS A REGULAR AFFAIR FOR US TO DEAL WITH THIS GOOD FOR NOTHING CONSUMER COURT, AND NOW ALSO FORGET YOUR HELMET AND BIKE COVER". WHEN I ASKED THEIR MUMBAI BRANCH MANAGER CONTACT NUMBER, THEY SAID THAT THEY WILL NOT GIVE, DO WHATEVER YOU WANT TO DO".

    Sir as of now, the bike helmet and cover are with them, the bike is not repaired and on top of that they are harassing like this.

    please guide me what should i write in this letter to be registered to them,i will write and will register post it within no time.

    I am even unable to use my bike due to no helmet and breakage-damages.

    please help me!!!

    Dear Mr. Gupta,

    Pls. send a written complaint to the Co. Head office and copy to Regional office of the Co. Give them a time frame of maximum 15 days to give you refund in that time frame. Also mention that if they are not going to provide you any help within that time period, you are going to file your complaint in Consumer Forum against both offices.
