from his side, I AM NOT LOOKING AFTER IT, THERE ARE OTHER DEPARTMENTS

I also contacted Mr. Shailendra but he is not picking the phone.

*LATE DELIVERY OF CONSIGNMENT*



On Saturday 8th August, 2009, i hired AGARWAL PACKERS & MOVERS (transport
Company), DEHRADUN (Branch Head : Mr. Khushi Ram Chaudhary, 09219860986; Ph
no. 0135-2762537) to Pack & Deliver (DOOR TO DOOR DELIVERY) my 2 year old
CBZ Xtreme, (Black Colour) Motor-Bike along with Black Full Face NINJA-STUDD
HELMET and Bike Cover from home, Dehradun (My Address : 837/3, Sirmour Marg,
Kaulagarh Road, Dehradun-248001) to Mumbai (Address: 1204-A, RNA HEIGHTS,
12th Floor, JV Link Road, Next to Greenfield’s, Andheri (E), Mumbai-400093).
According to the verbal agreement of terms, the bike was to be
door-delivered on or before Saturday, 15th August. The bike was packed and
loaded for transporting in front of me. The full consignment was in two
packs i.e. first packet contained my bike fully packed with side mirrors,
while the second packed packet had the helmet and the Bike cover. The
transport company charged me Rs. 5500 including OCTROI Charges in all. But
at the time of billing, the billing person had somehow managed to super
scribe the bill with wordings "OCTROI TO BE PAID BY THE PARTY" after taking
my signatures for consignment delivery, which was pre-included in Rs. 5500
according to the verbal agreement.



Since 15th August 2009, i had been trying to track my consignment and on
frequent enquiries to the Company, the only answer i got was that the
consignment had been dispatched from Dehradun and it is lying in Delhi. Then
by Sunday, 16th August 2009, i got to know that the consignment is late and
will only be delivered, by 22nd August 2009 at Point of delivery, in Mumbai.
But the Consignment got delivered on 24th August 2009, with the following
problems:

1. The consignment was unpacked, which was packed in front of me and
according to the terms and conditions of this company, was to be unpacked in
front of me, (i have photographs as proof of unpacked consignment), else
liable to be rejected.
2. Out of two packs, one bike and other containing Helmet and bike cover,
the second packet was missing (the delivery person said that they did not
get the helmet alongwith), while the side mirrors were already installed on
the bike.{Proof : the receipt says that helmet included).

3. The delivery man was asking another Rs. 2359 on behalf of OCTROI Charges,
which were prepaid alongwith the packaging charges in Dehradun.
4. The bike front light is damaged and there are many scratches on the
petrol tank and body (I have proof).

5. While unloading the bike, it fell twice in front of me by delivery
person.

6. The Bike was delivered 10 days late i.e. was delivered on 24th August but
was to be delivered on or before 15th August.



Therefore, with so many discrepancies, i finally rejected to take the
delivery of the late, damaged and incomplete consignment.



Next day, Mr. Khushi Ram requested me to negotiate and volunteered to get
my bike repaired and to get it delivered in the next two days with repairs
done for all the damages, but as for the Helmet and the BIKE COVER (the
other package of the consignment) is concerned, he assured me to get my
helmet Delivered by Friday, 28th August, 2009 to which I agreed to. Now on
the day of delivery, when they came to deliver the bike I found the Bike in
as it was two days ago condition and neither the light was not repaired nor
the scratches removed. The delivery person, Mr. Premarao said that he will
get the bike repaired & as for the Helmet and bike cover was concerned he
confirmed that it will be there by the intimated day and time and requested
me to accept the Bike to which i again agreed. He also negotiated &
requested me to deduct Rs. 1000 as caution money from octroi charges to
account for the damages and once I would get the bike repaired, I must
submit the bill to Agarwal company to get it reimbursed, with his promise of
getting the same done.


Today is 11th September, 2009 5.45 PM, and as of now the helmet and bike
cover have not been delivered to me and if i try to contact Mr. Khushi Ram
or the local person, Mr. Anup or Mr. Shailendra they either hang-up the call
or say that they will call back after tracing the consignments where-abouts.
Even my father called them to trace the consignment but they started
misbehaving and abusing and their Mr. ANUP said "DO WHATEVER CONSUMER FORUM
/ CONSUMER COURT YOU WANT TO APPROACH, WE ARE NOT AFRAID OF THESE PEOPLE AS
THIS IS A REGULAR AFFAIR FOR US TO DEAL WITH THIS GOOD FOR NOTHING CONSUMER
COURT PEOPLE, AND NOW JUST FORGET YOUR HELMET AND BIKE COVER". WHEN I ASKED
HIM HIS MUMBAI BRANCH OFFICE ADDRESS & THE BRANCH MAMAGER’S CONTACT NUMBER,
HE SAID THAT HE WILL NOT GIVE, DO WHATEVER YOU WANT TO DO".


I am even unable to use my bike due to no helmet and breakage-damages.



*List of damages and applicable charges are:*

1. FRONT MUD GUARD / TYRE GUARD BROKEN. : *Rs. 400*
2. SILENCER HAS A SMALL HAIR-LINE CRACK : repair charges approx. *Rs. 250

3. SILENCER COVER DAMAGED / RUSTED DUE TO BAD HANDLING. : *Rs. 400*
4. HEAVY SCARTCH or DAMAGE / RUST PETROL TANK : *repair / replace petrol
tank, depends from Rs. 700 to Rs. 6000(if tank replaced)*
5. SMALL LIGHT ON TOP OF HEAD LIGHT BROKEN : *Rs. 550*
6. CLUTCH ASSEMBLY ON LEFT HANDLE DISPLACED DUE TO BAD HANDLING : *repair
charges, as applicable. *
7. REAR VIEW MIRRORS HAVE SCRATCHES : *Rs. 1500*
8. LEG GUARD IN FRONT HAS DEEP SCRATCHES : *Rs. 400*
9. SCRATCHED ON FRONT VISOR (METRE GUARD) : *650*
10. WHEEL ALIGNMENT OUT DUE TO BAD HANDLING : *Rs. 250*
11. MANY OTHER SMALL SCRATCHES OVER THE BODY AND OTHER SMALL DEFICIENCIES
: *body rubbing charges, Min Rs. 400*
12. Apart from that, applicable spare part and labour charges:*Rs. 1000.*



I THEREFORE WOULD LIKE THE COMPANY, AGARWAL PACKERS AND MOVERS TO PLEASE PAY
FOR ALL THESE DAMAGES AND ALSO REFUND MY FULL OCTROI DUTY (Rs. 2359) PLUS
PAY ME THE LIQUIDATED DAMAGES.
