Dear Sir,

This is to register a complaint against the mental harrassment and mental trauma that i have been going through for the last 7-8 months
I had availed a personal loan from ICICI Bank as per details below in 2007.

The loan details are as follows:-

• Amount Availed : 2,50,000.00/-
• Date sanctioned : 14 March 2007
• EMI start date : 5th April 2007
• EMI end Date : 5th March 2011
• EMI amount : 7543.00/-
• Total payments made till date : 1,63,448.00/-

Due to certain unforeseen conditions I started having difficulties in paying my EMI’s on time and to top it all I was terminated from my job in the month of August 2009, without any prior notice.In January 2010 I got calls from somewhere in Punjab saying that it was the legal department of ICICI calling in to ensure that I pay up the loan amount. I got threatened by them saying that it was serious and they would have me arrested and I would be in trouble if I did not do a settlement right away.
I found out that the officer in charge here in Bangalore was a gentleman named Mr. Muthappa, who spoke to me eventually and when i expressed my inability to pay the loan . I spoke to my family members on this and my sister stepped up and said she will bail me out of this situation. I then spoke to Mr. Muthappa and told him that I have asked my sister to help me and requested for a settlement which my sister,Ms Vandana Brahma, who is based in delhi would clear it for me. I then put Mr. Muthappa in touch with my sister and mails were exchanged on the same , post which from February 2010 no response has come from the banks end. Please find copies of email exchanged below this letter itself.

Yesterday ie on the 10th of August 2010, almost 5 months after the last communication, I got a call from the Bank executive expressing that since I had not cleared my dues it would be sent to Mumbai to their legal deptt., for action against me. When I told him, his name was Ashish Ghosalkar, email id - ashish.ghosalkar@yahoo.co.in, I asked him for his official id he said they cannot recieve outside mails on their official icici bank id. I explained to him that I am unable to pay this as my sister is looking in the settlement. He said he will check and get back to me. Post this I immediately got a call from a Lady by the name of Ms. Preeti Sharma, who said she was an advocate , and ICICI bank official by the name of Mr. Ashok M has approached her for resolving my case and If I do not do something on this , a warrant will be issued in my name and Police will come and arrest me , and I will get into a big legal hassel for the same. She even told me from which Police station the police will come from!!!
When I told her that my sister is already in touch with the bank for the same and since I am unable at this juncture to pay, she is bailing me out on the same they should talk to her, in fact I told her my sister will call her and speak to her on the 11th of August.
Today my sister Vandana Brahma called Ms. Preeti Sharma, and when she asked her why Mr.Muthappa has not replied to our mails , she said Muthappa is no longer working with ICICI and we are responsible for finding out who is working in the bank on our case and keep following up on the same.
Tell me Sir is it possible for us to keep a tab on employees leaving and joining. When we told her that she started shouting at her and when my sister said this is not the solution , Mr. Muthappa should have replied to the mail sent to him as she was supposed to do the settlement on my behalf, she shouted back at my sister and was not ready to listen to what she was saying and banged the phone down. Post which Ms. preethi called me and again said that your sister or whoever that is does not know how to talk or this and that and said you better close your account or you are gonna be in big trouble, and tell your sister to pay the full amount now or do whatever you can.

I request your kind selves to please look into this matter and help me to come out of this situation as I am going through tremendous mental trauma and harrassment for the same. I am scared to take unknown calls at this juncture now. I am scared for my wife and child now too, am scared to move out of my house now that the sare of arrest etc, harrassment from collection agents on the same maybe.

Keeping the above in view I request you to look into the same and help me out of this scary situation now. My sister is ready to do the settlement but the bank is not responding to her letters.

Keeping the above in view I request you to look into the same and advise me as I am unable to pay back the loan at this juncture.

Please refer to the letter dated 12 Jan,2010 written by my brother Mr. Dinesh Brahma, wherein he had given the details of the loan availed and the total payments made by him till date. As per the details, he had availed the loan of Rs.2,50,000/- and till date made the payment of Rs. 1,63,448/- and the balance of Rs. 86552/- remained unpaid. Through this letter he had also shown his incapability in paying the balance outstanding because of his joblessness and poor present circumstance.



Also, refer to the telecon I had with you on the same date regarding my brother’s situation and wished to extend help to him in order to bail him out of this situation due to his several personal requests. I also briefed you about my self that I am married and salaried woman and have my own personal family and commitment towards them. However, on several requests made by my brother, Mr. Dinesh Brahma, I agreed to help him by whatever is within my reach and capability to settle the loan. Accordingly, during the telecon with you , I had offered to pay Rs.50,000/-(Fifty thousand only) as against the original principal loan outstanding of Rs. 86,552/-(Eighty six thousand five hundred and fifty two only), as full and final settlement of the loan outstanding as on date against Dinesh Brahma.



This amount of Rs.50,000/- is the maximum I can offer to pay for and on behalf of Mr. Dinesh Brahma to settle the account of Mr. Dinesh Brahma in full and final. My personal financial capability doesn’t permit me to go beyond this amount any ways. I think you will appreciate the situation and have a positive outlook towards the same.



Kindly send me the acceptance letter for the same with clearly stating therein that there won’t be any outstanding against Mr. Dinesh Brahma after paying the settlement amount of Rs. 50,000/- and this would be the full and final settlement of the account.
