The flat was booked by Arpit Jain(the seller) on 23rd Feb 2008 in KDP Infrastructure Pvt. Ltd. project KDP Grand Savanna.The allotment of Flat No.606, Block-A, KDP Grand Savanna, NH-58, Ghaziabad, was transferred in my favor in May 2011 by Arpit Jain(seller) and Builder. Now, I received Final Demand Notice from the builder (KDP Infrastructure Ltd.) in March 2012. In this notice the builder has claimed Rs. 161733.00 as interest on delayed payment and Rs.110.00 as cheque bounce charges for the payments made by the seller (Arpit Jain) in 2008. Also, the last page was addressed to Mr.Arpit Jain, where calculations for these charges were shown. On contacting the builder’s office (after receipt of the notice), I was informed that this was a system error and I should make all the payments after deducting the charges and a fresh Final Demand Notice would be issued after correcting this error. I made the payments on 25th March 2012 as per the discussion and on good faith. I also sent an email to the builder on 26th March’12, confirming that this was an error and needs rectification. However, I did not receive any response nor possession of the flat was offered (even after 2 months of making the final payments due to the builder at the time of possession). On visiting the builder’s office on 14th May’12, I was told that the possession and NOC from the builder can not be given due to pending interest on delayed payments. I sent mails to the builder for clarification and also sent a registered letter. In response, I have been told that, since I am the transferee, I am required to pay the charges levied. However, there is no justification or supporting documentation provided for the same. Please note that: 1. The charges now being levied pertain to 2008 and were supposed to be charged from the seller (if due). 2. There was no intimation of these charges by the builder at the time transfer of allotment. 3. The final demand notice is addressed to Arpit Jain (seller) on the last page (where calculation pertaining to the charges has been shown). 4. The builder was supposed to claim any dues from the seller at the time of transfer of allotment; however, there was no intimation ever from the builder regarding any pending interest on delayed payments to either seller or me. Moreover, the builder is also asking Rs.10, 000 (cash) as bribe for registration of the flat. I have taken loan from Axis Bank and bank is in possession of all the property documents. I have requested a copy of property documents from bank to support my case. Also, the builder was in possession of 95% of the payment since more than 4 years and did not offer possession yet. Further remaining 5% was also paid to the builder in Mar'12.
