    Default complaint against builder

    Our society has build up an extra room to the existing house.the rooms have been build back in 2010 and now its 2012 and theere are heavy cracks on the walls on both sides.did a complaint to the managment of society but they are not willing to take action against the builder may be due to sometype of understanding between them.

    I need to have the justification for the money i have paid.

    Default Complaint against M/s Amrapaly Group

    Madam / Dear Sir

    I had booked a 1575 Sq. Ft. residential unit no. 304, Tower L, Phase II, under cash down payment scheme, in one of the ongoing project of M/s Amrapali Group i.e. “Amrapali – Heartbeat City 2, Sector 107, Noida through Investor Clinic on 7th October 2011. At the time of booking, the company had promised me for a complimentary 2N + 3D trip to Singapore for a couple. The scheme was also advertised in various newspapers.

    As far as my payment schedule is concerned I had kept my promise and paid all my commitments much before the scheduled dates as mentioned in the Agreement.



    Repeated requests were made to the concerned officers at Amrapali Group & Investor Clinic through mail, telecom and personal visits, for providing me the singapore trip, the company offered and promised to me but all in vain.



    Through this mail, I request you to kindly take up my matter with M/s Amrapali Group and guide me what to do in this case.

    Angry Poor Construction done by IKS Builders for the entire Apartment in Villivakkam North Jaganatha Nagar

    Dear Sir/Madam,



    Recently (Registered on 14th November 2011 and possession on 5th February 2012) I purchased a new flat in Villivakkam constructed by IKS builders PVT Ltd - Chennai, now there are lot of cracks (Horizontal & vertical) on both the side of the wall, when I asked builder about this initially he said will send a person and do rework but none of them came to the site when I again asked now he simply deny to do the rework and say that after one two years do putty finish and re-paint this will be resolved this is a simple air crack.

    My Question is if it is a air crack how can it will come on both the side of the wall and it is not one or 2 craks totally it is 12 cracks both the side (12 x 2) and day by day it is increasing. This issue is not only with me to all the flats in the building having the same issue. Same responce came from builder to all the falt owners.

    He never want to do the rework and the amount which I have paid to purchase this flat is not that much valuable.



    Four months have been rolled out and till now he didn't handover the documents approved Plan, Corporation tax, Water tax cards to me even the completion cerrtificate, for this he has collected 1.5 lakhs he didn't give proper break up how much was paid to Government.

    I have purchased car parking but till now he didn't mark the parking area which is allotted to me, mean while other flat owners saying this a common parking and builder conveyed to them that he is not going to sell the parking to anybody since it is common for everybody but he took 2 lakhs from me for the reserved car park, as per Supreme court order builder doesn't have access to seel the common parking to any one so I requested him to return the amount which paid for the reserved car parking but there is no responce from him.

    I would request to take action against this builder so that any body who want to purchase the flat which is constructed by this builder will be saved and infuture he will not repeat this mistake again.

    Default complian against bptp developer

    Greetings of the day!
    I( VIDUR JYOTI customer code- BE 72/133153 Project- ASTAIRE GARDEN) personally visited your Gurgaon office to submit buyer agreement but BPTP office colleague refused to accept the agreement and told me that your unit is on cancellation because i didn't submit the due amount.I clearly told him that i had a approval from ICICI Bank but bank refused to pay the amount because projects are not approved from ICICI bank and currently i don't have approvals letter to submit as a proof. I am in touch with HDFC bank regarding loan but they will take 25- 30 days for approval. your office colleague told me that BPTP will cancel the unit and deduct some charges. please tell me what my fault in this ?

    when i finalized this project my broker told me that b.p.t.p very reputed and ethical builder but this kind of behavior not according to your reputation or might be my perception was wrong .


    I was not assuming this kind of services from Reputed builders like B P T P.

    its my humble request to please provide me SALUTION REGARDING THIS.

    Default Fraud darshan builder

    i have purchased 2000sq ft from darshan builder bhubaneswar on sep 2009. I have taken registration of the said plot no 596-c . But further the builder priyadarshan in not giving possesion and mutation of the said plot for which he has already taken full money from us and telling that he is not afraid of any court case and all.pls advice.my contact no is 9707067079.

    Angry complaint against Paradise Group

    Complaint against Paradise Group, persepolis building in Vashi.

    Hello,

    First I sent complaint by an email to M/s. Paradise Group, but we have not seen any improvement. As they had promised/committed us they will give us all the amenities and they have collected all the money with penalties. They said us flats are ready (in ready possession) but it was not in a position of stay. According to plan there should be garden on first floor with gym and club but he had made flats.
    As they provided amenities in the brochure, they will give us Air conditions in the lobby, gymnasium and pool table in club.
    Ready possession means all the amenities and all the work should be completed before the possession. Here we found there is uncompleted work like light work, water work, flooring work and etc. I have heard they had charge 3 lac for parking. As I heard the parking should be free of charge.
    They should clear water problem because still tanker comes for water and later they will deduct from maintenance. To provide pool table and complete the work of all the amenities whichever they had promised us. There should be glasses in the lobby because the air should not go outside.

    Evershine builder in mumbai advertise for new project eversine cosmic in 2005 and suppose to give flat possession in 2008 and now its 2012 but still flat not recived.its a great cheat the mock up room and product now has no comparision,than promised for pool and garden all gone in vain and our 4 year of life has gone in a small house staying in rent and trauma its been almost 8 year such builder should be behind bar not cheating our money butvalso playing the feeling .my 3 year son id asking dad when will go in big house now he id 8 year is my child gr8 time builder can he return back taken almost all money still flat not recvd i want atleast 60 laks comensation from them my name sudhanshu kumar singh email ggm@rameeguestlinehotels.com 02226485421

    Building name pal Villa which is situated at Gundge behind good Shepherd convent school

    builder built 3 illegal flat against plan and no one visit the site varification and give him complition

    certificate.And also he is not provide basic facilities which is given to the plan.

    So pls do the needful .

    Angry Jaypee Greens Garden Isles, Wishtown, Noida (JPBuilder), wrong interest and penalty imposed.

    This is regarding the purchase of 3BHK flat at builder JP (Project name, Jaypee Greens, Jaypee Garden Isles, Sector 133 Noida Expressway, UP?)

    I booked a flat in November 2011, via giving 3.5 Lakh amount. At the time of booking, a promise was given to me that, all legal aspects are complete with the project. (paper work, maps, formalities/etc.) And any bank will finance the loan. while JP?s official loan partner bank is Axis bank. Then I started contacting with Banks(initially with LIC and IDBI). But later LIC informed me that, ?there is issue with project documentation, and builder is changing the maps/etc. and revised things are not approved with LIC?. And approval will take minimum two months of time. After that, I started with Axis Bank. (being a JP?s official loan partner bank is Axis bank) But on 30 December 2011 Axis bank also said the same thing as LIC (?builder is changing the maps/etc. and revised things are not approved with LIC?)

    Accordingly, I wrote to JP/builder informing the same that, even Axis Bank is denying the loan (in normal period of 15 days). Then the people from JP/Builder side suggested me to go for loan from private bank (as they have less formalities and lenient) On that advice I started the loan processing with ICICI (As at that time, ICICI was the only banking which was providing the loan for JP, Garden Isles) [Note: during this entire time/period, I was continuously updating the JP/Agent persons]

    Finally in Feb the loan was approved by ICICI. (during this period JP and Bank people were communicating with other) After the loan approval from ICICI,I wrote to JP via requesting them for not imposing the interest penalty. (And said, then only I will pay the remaining amount) Then, I was contacted by JP peoples (Agent/credit department) and they said, we understand your case (the delay is not because of you, it was because on bank and builder formalities, as maps/etc. were in-process)

    So, you (customer/Amit) don?t worry and make the remaining payment. After the payment we (JP/builder) will formally start your case for interest waive off and your penalties will be undo. On that commitment, I made the full payments of (~30 Lakh) and wrote mail for JP/builder for waive off of interest. I did multiple follow ups with JP/builder but got no reply for 2/3 months.

    One fine day, on 13 June 2012, got mail from JP/Builder via saying you need to pay the interest/penalty.
    This really unfair/unethical with me. Please advise/help me in this regard.

    Default complaint against Pivotal Infrastructure Farida Bad and Ansal Buildwell

    My daughter has got a flat booked in Tower No. T-4/103 in Royal heritage Faridabad .This project is being developed by Ansal BuildWell and being promoted by Pivotal Infrastructure Pvt Ltd Faridabad The payment plan is construction linked . The demand is being made much before the particular stage is reached. When query is made, it has been told that that stage will come when yu will make the payment. I requested them to send the photographs of the site showing proof of status of work on particular Tower but no reply has so far been received from them. It is just a harrassment to the customer. Please take necessary action against the promotor and the builder.

    Default Complain against Builder 'Earth Infra Pvt Ltd' of Noida Extension

    Dear sir/ Madam,

    I booked a flat in residential project 'Earth Towne' of Earth Infra Ltd in Noida Extension in 2010. I paid 20 % at that time before the trouble started in the noida extension area in 2011. When the project got clearance from NCR planningboard in Aug 2012 then I visited the Earth Infra ltd office in Karol Bagh, New Delhi for the payement of balance due amount . Now when the project got clearance fron NCR planning board , rate in the area was increased by about Rs 1000/- per sq ft. Now Earth Infra is institing that I have to pay the amount as per new rate and my booked unit will be considered as a new booking . The rate at which the unit was booked at the launch of the project in 2010 will not be applicable now. Since the rate in the Noida Extension area is increased now the builders are in total profit by cancelling and rebooking the unit to some other customer.

    Kindly look into the matter. I appreciate your assistance.

    I am Dinesh Agrawal, I was deposit Rs. 1,75,000 vide cheque no 546162 of HDFC BANK Bhiwadi dated 11.11.2006 for advance on account of flat @ Rs. 1450 sq. ft. Size 1200 sq. ft. at M-Tech Heights Bhiwadi (Raj.) and I have got receipt of money deposited to M-Tech developers, receipt no 9003 dated 30.11.06.


    As per their commitment in advisement they will finished this project within 24 month. Actually they have not started any activity in this project. and they have shown in their web side project has started. address of their side. I was visited office more than 10 time . they have not responded properly. and I was also sent one legal notice and letter thru mail but they have not reply.



    I want to log FIR no 160/09 against m tech developers

    Default Complaint against BPTP

    This is in regards to my unit in park floor-II sec-76 faridabad. I am extremely frustrated with my experience with BPTP and not even me it’s for all of us
    From booking date in 2008 to loan disburse in 2011 ,on demand generated they replied as...”demand are system generated so it will be sent to all customers, Since you are bank loan case and having of sanction letter, so no interests will be charged”(on demand pending).

    In March 2011 bank has been started disburse of loan amount, I received a letter of dated 03 march 2011 of pay my outstanding amount of Rs 1885070.00 on or before 18 March 2011.
    I had submitted my revised loan sanction letter from Axis bank on dated 24 may 2011 and have made all my outstanding payment on dated 09 June 2011 and same time it was confirmed from BPTP side that no dues is pending now.

    Now few days back it was shocked to receive a letter of Interest against of delay payment my unit of Rs 98931.Delay in payment is not because of me but it is due to delayed in process because the things like land approval and agreement were never ready as promised by BPTP until 2011.But They are not entertain any customer on this.
    Now last week, I have again received unexpected and unscheduled reminder-1 of outstanding balance amount of Rs 98931.
    I am fail to understand, I have paid 90% of payment even after so much delay in possession, how they can ask interest on delayed payment while all the payment has done on time ?

    It was very shocked to me that now they are refuge to adjust my balance broker discount of Rs 42500.
    Let me update it, I have got total discount Rs 85000 from broker kapour estates and have to adjust in two installments. One installment of Rs 42500 already been adjusted on 27.07.09 Now I am asking for balance Rs42000 which is pending for adjust since from long time. After regularly follow-up very surprised, see how BPTP had reply me on this query. (I have proof in writing from broker of Rs 85000)
    1. On 17.07.12, They replied as.. “We regret our inability to adjust the brokerage according to the credit notes attached”
    2. On 16.10.12, they replied as...” With regard to the broker’s discount, we would like to inform you that the broker’s discount of Rs. 42,500.00 has been updated in your account for the said unit. Therefore, the basic sale price of Rs. 2,379,780.00 stands revised to Rs. 2,3372,80.00 in our records accordingly.(They don’t know it is in two instalment of Rs42500)”
    3. On 26.10.12 they replied as...” Further, we would like to inform you that as per the company term the brokerage shall be adjusted at the time of booking itself. The same was already communicated to all the brokers and were asked to submit any pending credit note by 12 January, 2012. Therefore, in view of the above we regret our inability to extend further broker discount towards the said unit”.
    At present broker also behaving same as BPTP, he also not taking any interest on this. Now it’s a big changeling for me to adjust Rs 42500.
    This is one example how BPTP has done a big injustice to its customers.
    In short our points of contention are the following:
    1. How can they charge the interest when they only received the approval for this project in March 2011.
    2. Why not they adjust my balance broker discount of Rs 42500.Why they replied me with new story each time.

    Please suggest how we can get justice against this.

    Angry Grievance agains Supertech Apex Project

    I have not received any suitable response from Supertech on my enormous letter and followup with them till now and would like to seek help from some authorities to get the builder take some action.

    Subject: Delay in construction and possession to Supertech Apex Project Sector 93A Noida
    I had booked a 3 BHK Flat in Supertech Apex project (Emerald Court) Sector93A at Noida in December 2008.

    Since 2008 till date the progress has been very minimal and Supertech is taking its own sweet time to construct the tower. Supertech has raised the number of floor from 24 to 37 without any information and this has further caused delay to the Project. During this time I have visited the construction site many times and found the speed awfully sluggish and slow. Supertech has constructed 15 Floor as of date and is taking almost 2 months to add a floor which is partially constructed. If we go by this speed, construction of another 22 floors would take minimal 44 months and another 24 months for finishing and giving possessions. That calculates to about 68 months (more than 5 years from now). How do you justify this?
    I was being promised to be given a possession Last year December 2011, and it does not look like any possession on this project could be given anywhere in the near future. The Project seems to be entirely fraud and harassment to the customers who have trusted Supertech and have invested their hard earn life time investments into this project. This project and its progress is a shame for the Supertech management and will definitely ruined and spoil the reputation of Supertech. 9 years against the committed 3 years for constructing of a tower and giving possession. How do you justify this?
    Any projects launched during the same time by any other builder around the same vicinity has completed or almost completed with their structure and are offering possession or will be giving possession in the next few months.
    I do understand every project might have some technical difficulties delay which could be considered reasonable, however any delay of more than a year in a project portrays bad planning and execution of the Builder. Currently I am spending approx 30K in EMI and 17K for rent, my hopes to live in my home by 2011 have been shattered in all ways by Supertech, I am not able to plan the future as to which school he will go, how long will I need to stay on rent, how do you justify this?
    If I pen down everything, this mail would go on and on and on. Therefore I have keep this mail short as I believe you would already be aware of the issues and the delay in the construction. I would want Supertech management to take some action on this and provide me with some alternatives. Probably allocate a similar house in any of your existing completed projects, as by now I should have the possession of a completed ready to move in flat in Emerald Court Sector 93 Noida. Provide me a house in Emerald court as exchange or till the time my house is being constructed. Reimburse the amount I am paying as rent.
    I look forward for a favorable response and alternatives, also I would like to meet the Management in person to explain the harassment I am going through due to Supertech.

    I have taken flat from charbuja developers Purchase in 2011 may buying amount 8,30,000/- & we paid to total amount to builder but the builder not to do for lite a water, He did not put us light mete of whole building or not paid a previous a electric bill & he can not even give us Registering so pls help to us what we do now we paid to all i want to help your pls
