Query on consumer rights when one gets items serviced There are many times when as a consumer we get electronic as well mechanical gadgets repaired. One of the things I have noticed is that except for the authorized car workshops nobody returns the replaced part to the consumer. Some even boldly claim that repaired/replaced parts will not be returned. Isn't this cheating the consumer? What right they have to keep something which actually belongs to consumer. I can understand this policy when things are repaired under warranty or guarantee. In the absence of this, the service agent has no right to keep something which belongs to me even thought it might have gone bad. After all I am paying him for the new
item anyway. So why should they keep the old item with them.
What are the views of the board members regarding this? What does consumer protection laws in India say about this practice? isn't this illegal? Isn't this practice a violation of the rights of the consumer to keep something for which he had paid?
U have a recourse to file a police complaint for CHEATING, against the service provider, under the circumstances U have described where U are not returned the replaced part inspite of insisting. Though this would not consitutue as deficiency in service unless of course you prove that the returned defective part was actually working properly and was not defective.
Here you can file two complaints : one police complaint for cheating and one under the District Consumer Forum.
