I have booked a marriage hall in Chennai to be occupied on september 7th for proposed wedding of my sister which got cancelled. After receiving the cancellation request letter from us, the owner of the marriage hall promised to return the advance amount of Rs.20000 that i paid once another party books the hall for the same date. I came to know that the hall is blocked for the day for marriage by another party now and the owner of the marriage hall is not paying my advance amount back and giving lame excuse reasons like hall is yet to be booked and he says he wont pay the advance amount that I paid. Can i file a consumer complaint against the marriage hall and the owner and will i be able to get a stay order from the court barring any functions to be conducted if the owner doesn't pay my advance amount? As the event is yet to occur, if i register a writ petition in the district court will i get justice immediately or a consumer court alone will be able to help me in this?
Please suggest me how to approach the court for filing such cases.
