I need some help and justice here.
I went to enquire about Weight Loss program for my wife along with my wife and kid. I had been to Inspirations Pvt. Ltd., Marthahalli , Bangalore.
Everything was smooth and fast, there were many programs explained and as part of payment options they said, my HDFC credit card could be used to pay the weight loss program fees by EMIs for 12 months. The program costs 27,574 /-. i swiped the card and i also signed the payment receipt. They gave me a Cash memo for the same amount. This happened on 09.03.2010.
We explained the authorities there that we would be away for vacation the next one week and would be commencing the course , tentatively on 22nd March 2010.
After we returned our vacation, the situation on the personal front changed, and we were not in a position to take up this course any longer. We required this money and time for our family situation.
We explained this and request for a refund. There were many explanation trying to convince us for commencing the course etc.. Our situation did not permit us, so we insisted on a refund.

Mrs. Aarti, the Area Manager at Inspiration, suggested that we should submit a written request and would get back to us after consulting their Panel of management on this. i submitted a written request on 24.03.2010.
After a 3 weeks, when i called, the area manager, she said that there is no proper policy in place for refund and i will not get that money back.
These were the reasons mentioned:
- No refund policy
- there is no one person as decision authority for such issues. There is a big panel.

The cash memo given to me also stated that the money is not refundable.But, regarding cancellation, there is no mention.
I understand all these aspects, but since here the course has not commenced, the consumer should have flexibility to revert back at this stage.
Even on written request , this request was denied. I think for programs/courses, which have been commenced just enrolled should be allowed refund if needed.
i have already paid 2 emi amounts, but i am trying to get a full refund. When i called up Credit card bank, they said the amount fully has been paid by the bank to Inspirations, any refund they should give me...

Kindly help in this regard...Kindly note another judgement with the same company, branch where the consumer was successful in getting refund even after the course was started...in my case the course has not been started
