I had purchased a Bajaj Discover 135 vehicle Reg# KA02-HA-911 availing a loan of Rs 44,000 from Bajaj Auto finance in Sep 2007 payables as 2173 in 23 months
1. The loan was supposed to be cleared as an ECS from ICICI Bank for which cheques had been provided to Bajaj auto finance by me.
2. Though all requirements were furnished towards ECS and there was sufficient funds always in my account the first 4 installments were collected by the collection executives in cash.
3. After the 5th EMI paid through cash I moved abroad for a training for 3 months during which I managed to speak to one of the collection executives by calling all the way from US to my home when he had visited my home to check why the ECS facility was not going through in spite of all the requirements met and Cash payment was not preferable by me.
4. The agent promised that further EMI's would go through in ECS and no collection agents visited my home for next 4 months after which the EMI started deducting from my Bank account and regular payments made till Sep 2009.
5. After I returned from US i tried to locate the Bajaj Auto finance office but couldn’t trace it.
6. Tried to contact them over the phone but the phone was not working...Even today the phone numbers provided as 08023525762/63 is not working.
7. Mean while I had shifted my home and could not update the address with the financier due to above reason. The Bajaj showroom staff also didn’t co-operate me in finding the Finance office location. I had also sent an email to one of the email ids found in internet in August 2009 and forwarded same email to [B]baflcustomercare@bajajauto.co.in but no response was received.
8. On 09 Oct 2009 my vehicle went missing from a parking area and immediately I requested my brother to check for this address and verify if my vehicle was ceased by the finance. He was successful in locating the office and they confirmed orally that the vehicle was not ceased. I also got their toll free number and placed a request to notify me on my phone 9742771999 incase the vehicle was ceased.
9. After learning there was no ceasing of vehicle took place an FIR on Vehicle theft was logged in respective police station.
10. Even after a month of this incident the Bajaj Finance staff was still saying that the Vehicle is not ceased and I carried out procedures to avail the insurance on this vehicle.
11. The finance company had by then levied different types of penalties and charges which were totaling to 21,000+ against missing to pay 4 EMI's during my visit to abroad.
12. After I arranged the fund to pay it off on 31st Dec 09 and went to the Cubbon park branch they shocked me by saying that my vehicle was ceased before a month and was already sold to someone. They made me run to different branches for this.
13. This entire incident has made me to under go a lot of confusion and mental agony and physical strain.
14. Firstly the Finance company miss-guiding me by saying the vehicle not to be ceased and then they have already sold it.
All of my family members were under depression since Oct'09 and the thought of the vehicle makes them grim.
Please help me to get justice in this situation that I have paid 19 out of 23 EMIs correctly and though I was capable of paying up the rest I have lost my bike which was a dream come true for me.
I need my vehicle KA-02 HA 911 in which ever condition it is, and I shall not be able to pay more than my 4 EMI’s pending.
