I have a complaint against ICICI-Lombard General Insurance Co Ltd
(ICICI-LOMBARD).

Their marketing person collected a cheque from me personally on
19-09-2006 for my car insurance which was expiring on 30/9/06. My cheque was
cashed by them on 26-9-2006.

When I did not get my policy I went to ICICI Bank Vashi Branch where
ICICI-LOBARD had a desk to enquire the status. I was told that my cheque
was bounced and hence policy was not issued. I showed hard copy of my bank
staement. Thereafter nothing happened. I follwed it up with e-mails,
letters and telephones. All I received in return a letter telling policy
will be despatched. But nothing was received by me.

I then got a policy from other insurer and asked ICICI-Lobard to refund my
money. Then they started bomarding me with IRDA regulations and so many
thing and in the end they said some 900 odd Rupees will be refunded out of
4500.

I represented the case to Insurance Ambudsman. To my horror I was commented
upon during hearing that I approached the Amudsman on an instigation!.
However an unacceptable award was given in which ICICI-Lobard was to refund
the premium deducting the amount as per IRDA regulation.

My case was that ICICI Lobard failed to issue me the policy so they should
refund full money with interest. I had submitted to Ambudsman that I am not
fighting for money (I even offered to donate it to the project
suggested which is helping citizens fight these biggies from their bullying)
but ICICI-LOMBARD should be restrained from doing such shortage in service
and penalised suitably for their failure in communication. My main
submission for ICICI-Lombard' statement that policy was sent by courier and
returned finding nobody in the house was that when ICICI-Lobard is so
particular in collecting the payment personally, why the policy also could
not have been delivered to me personally. And how's that I was told that my
cheque had bounced if the policy was issued after all.

Amudsman's award clearly mentioned that except the refund what ICICI-Lombard
was talking now aother award is given. Meaning that ICICI-Lombard can
continue doing such mischief.

I need your guidance. How should I persue the case with Cosumer forum
platform. I shall be ever grateful for the help.
