Oriental Insurance | Scooter | Death Case | Not Honouring My Dad passed away in an accident while driving his scooter to his office. This happened in last 'Nov 08'. After we came out of that uneventful & sad event we decided to put claims related to all his insurance's.
One of the insurance is for the scooter he is driving. It is with Oriental Insurance. We submit the claim to them and after taking 1-2 months they came up with us to tell that the claim can not be honored because the RC of the scooter has expired.
The scooter is a very old 1987 model and they told to us that the RC only lasts for 15 years and that it could have been expired in 2002 if it has not been renewed.
We didn't have any information on that because my dad used to handle all this stuff. BUT i asked them a question, Why your company has done the insurance if the RC is expired? and if it did .. then why it is not honoring that claim?
To this they didn't have any specific answer at that time and they said that we will further do our investigation and let you know.
After around 8 months we received their reply which is that the RC got renewed in 'June 03' for 5 years and it got expired in 'June 08' unless we renewed it. And they also states that if you renewed the RC please revert back within 7 days with the xerox of it otherwise the claim will not be given.
To my shock the June month is the period when the scooter insurance has been done each year.
I couldn't digest the fact.. I thought they are covering up my question to them that why they've done the insurance on an expired RC if they're not honoring that. because they can easily say that.. we've done the insurance in 'june 08' when the RC is still valid.. after that you didn't renew it .. so it is your fault and we're not giving you the claim.
I also enquired the same from the RC office and they also said that the RC is never renewed.
What is the outcome of all this?
Is it a law that the claim was not given on an expired RC?
If the RC was expired, Is it still possible for the company to do the insurance, and if it does.. isn't the company liable to honor that?
I'm really pissed off with their reply and not sure on how to proceed on this?
Any help will be appreciated.

Dear Mr. Sharma,
Kindly send a written complaint to the Head Office of the Co. and wait for the response for near 15 to 20 days. Keep a copy of that letter with you so that if the Co. fails to give you any solution, you can forward your complaint to the Insurance Ombudsman. The head office address is:

The letter which we received is from the local branch office in chandigarh. That office is asking for our reply within 7 days... Should I send the reply to that office (through registered post).. or should I send it to the Head Office in delhi??

I enquired from the RC office again in detail.. and they are now also saying that the RC got renewed in 2003 for a period of 5 years.
Now my only question is.. Is this a law that the Insurance company will not honor the claim in case of the expired RC??
We don't have the documents if the RC is renewed or not. My dad used to handle all these things by himself...
So what's our options right now.. Can we get the claim or not?

Dear Mr. Sharma,
The Co. can reject the claim on these basis. As if the Insured vehicle is not valid then the Insurance also can't be considered as valid. But there is not harm in writing to their Head Office and ask about their terms and condition in writing. May be we can get some help by this way. You can also go through the website of IRDA for any additional help.Regards,
